    I am claiming from Lloyds TSB on behalf of my daughter, we have been dealing with Moneyclaim and Lloyds have acknowledged that they will defend the case. As I understood it, they had twenty eight days from the date that they were served with the claim, if they were going to go to court. They were served on 10th May.

    I have just looked on the moneyclaim website and the message from them is that I can no longer do anything online because Lloyds are going to court to defend themselves and that we have to wait to hear from the court.

    I am hoping that the court is going to be a local one to where we are, the court that Moneyclaim uses is in Nottingham.

    I was hoping that they were going to have paid up by now, but it seems I am going to have to do the whole court bundle thing.

    I swear to god that I will never have anything to do with Lloyds TSB ever again.

    It is Andover who sent the letter regarding the 750 - Lloyds 'recovery centre', which has dealt with everything up to now. I will indeed send my next letter to them accepting only partial settlement but do I need to send court papers to Gresham Street ultimately ?

    Also just read something on CAG site regarding the glitches than can occur with MCOL and that it may be preferable to file with an N1. Where / how does one get an N1 ?

    If you are using MCOL you don't have room to enter anything other than what is in the "short version" of the POC, in the Reclaim Help Thread.

    You don't send the court papers to anyone at the moment, if you file on MCOL the will transfer your case to whichever court is nearest to the address you give.

    You'll find links to the courts webpages in the Reclaim Help Thread along with the bank address that you need to use. You can download the N1 form from the court webpages or you get them at your local court.

    As you are accepting the £750 before you fill in MCOL you must deduct this from your total claim.

    hi all was getting me hopes up then after seeing some 1 got £750 good will jesture and saying they included the charges as well for the month i thought they hadnt took wot i owe this month and i was going to get a letter this week cos i phoned andover last week . just found me statements for this month and got the date wrong me charges come out 2 morrow for £300 oh s*** lol looks like a fone call is due again cheers john

    Probably been covered already and I have missed it! I have a current account and a credit card, both with Lloyds TSB and both have a number of charges over the last few years. Does anyone know if I have to make two separate claims or just one? Not sure as they have different departments.:confused:

    Please can someone let me know as I am just looking into claiming. I am 4 months pregnant and could really do with any extra cash about now!!

    I have gone through the process of 1st letter 2nd letter,the 14 days where up on monday.I had heard nothing,filled in court paper on tuesday went to banks online sevice to check my balance before making payment for court.
    I found that over night on Monday the bank had placed £750.00 in my account and called it a goodwill payment. I have tried to contact Bank by phone to no avail,Ihave faxed asking them to call having had the same responce zero.HAS THIS HAPPEND TO ANYONE ELSE ?CAN ANYBODY TELL ME MY NEXT MOVE I WAS CLAIMING £3000.

    Is there a letter template on this site for writing to the bank to say: 'I accept the £750 without prejudice as part payment of my claim, but will be pursuing the remainder through the county court' or whatever, etc..

    On another note. If I am claiming £XXXX and they have offered me £750. How does that work for interest, for when I take it to court?? Do I make it as follows?
    £XXXX (total of charges)
    + interest of £XXX
    = £XXXX
    - £750

    OR

    £XXXX (total of charges)
    - £750
    = £XXXX
    + interest of £XXX

    ??

    hi sadie i would say you would have to send to different letters i have a account wiv tsb andi a credit card , got me statements for me account , havent even wrote to the credit card place yet, i would get writing asap think tsb is one of the worst to deal wiv pple quoting 6 months to get there money back cheers jill

    for my LTSB claim, the amount would have been more than £5,000 if I had added together totals therefore dealt with them separately. For my RBS claim, which totalled less than £5,000, I quoted both accounts( ie credit card and current account) and account numbers in the particulars of my claim and just lodged it once. The court accepted this and it has been served on RBS so this way seems to be acceptable.

    Hi The One I hope that this is what you are looking for it is a letter i got from a differant thread it is one that i used you just have to tweek it a bit ok.
    'Thank you for your letter received today.

    While you state in your letter that you believe the charges levied are fair, I contend that I do not believe these charges reflect the true cost to Capital One.

    The charges, as stated in my schedule provided to you, total £ 518.00 plus, as I believe I have been unlawfully deprived of the money, I have calculated £119.64 interest at the statutory rate.

    I therefore ask that you repay me the full amount of £637.64. I have, again, attached a full schedule of the charges and interest with this document.

    You have stated in you letter received today that it is your intention to calculate what you believe as fair charges and offset them against my claim and you have advised me that you are crediting my account with £190.00. This credit is not at my request and not what I have claimed. I do not accept these as fair charges. I noted your comments regarding the reduction of fees, but under the Unfair Terms in Consumer Contracts Regulations 1999, charges must reflect administration costs and cannot be punitive. I believe that the charges you have applied to my account have been unreasonable and punitive.

    I cannot, therefore, accept the sum of £190 as full and final settlement of my claim for £637.64 referred to in my letter dated April 4th,2007. I will accept this sum of £190 as part payment only, and without prejudice, but will continue my claim for the balance.

    I will, however, be prepared to accept a full and final settlement of £518.00, less the £190 you state has been credited to my account, as full and final settlement which are the charges less the interest. Failure to agree this will result in action being taken through the Courts at which time I will request refund of all charges plus interest plus costs.

    Please note that, as I have provided clear and documented evidence of my claim which you appear to continue to dispute, I will be instigating Court action in 3days unless you agree my claim.
