  • Hi Everyone

Can you help? First posting on site.

I hit the TSB for £1824.72 of what I think are illegal charges broken down as follows.
    Account charges £274
    O/D usage fee £25
    O/D interest £58.22
    O/D excess fee £1145
    Unpaid DD etc £322.50

    Have been offered £750.00 today.

I know I cannot claim O/D interest having looked at your postings so I don't expect that back. But are there any other of the above charges that I cannot claim?

If all charges above are illegal, is £750 reasonable to be offered.

    Thanks for your interest.

The decision is yours. Personally I would pursue for the whole amount, but it's up to each individual and their situation as to what they accept.

One other thing, the charges are considered unlawful not illegal. This is a civil matter, worth remembering if you do decide to take it to court.

    hi all...

I have started the process of claiming back £175 of charges from Lloyds. I didnt need to send the DPA letter because i know exactly what and when i have been charged. I sent the 'stage 2' letter to Lloyds2 weeks ago and got a reply this morning saying that that they deem the charges as exceptable blah blah blah and to send a cheque for £10 for my charge statements giving the reference number given in the letter or to take it up with the financial ombudsman.

Do i ignore the letter and carry on with the next stage? In the next letter do i state that i did not ask for charge statements etc?

    Cheers in advance

That is just a standard fob off letter from lloyds, most of us have had one of those. just carry on with your next letter (LBA)
Just keep reminding yourself that ITS YOUR MONEY and you want it back.

If you cant face taking it to court contact the Financial Ombudsman who can deal with your claim on your behalf ( free of charge)

    Dont give up!

    Hi Everyone

First posting. Can you help, please.

TSB has offered £750 to settle my bank charges dispute.

Can you tell me if any of the charges that I have claimed for are not claimable.

    Account charges £274
    O/D usage fee charges £25
    O/D excess fee charges £1145
    Unpaid dd charges £322.50
    Total £1766.50

If my charges claimed for are correct is £750 are fair settlement?

    Replies most appreciated.

Yes you can claim all of those, it is up to you as to whether you are goin to accept their offer, what you can do is write to them and tell them that you accept this payment as a 'part payment' to you claim without prejudice and you will persue the claim for the rest of the monies owed. There are template letters in the library to help you,

    Best wishes

Not sure that you can claim
    Account Charges
    O/D usage fee

But you can claim the O/D excess fee and Unpaid D/D fee.

If this were my claim, there no way id accept £750 !! thats only just over 50%. But that decision is yours.

    GOOD LUCK

Most of the people on here are claiming themselves. You would have been better to contact the FO as they carry more weight with the banks than one of those companys.
Dont know what pecentage your company charge but its usually about 25%. So if they are successful with your claim you will have to give them £472.16!!!

The FO would have done it for free

    GOOD LUCK
