    HI can anyone help???

I am currently trying to claim £3800 from Lloyds bank - they have until the 11th to acknowledge my claim.:D The probelm is I have a loan with them on which I missed a few payments, it is now with the collection centre and I am on a payment plan. Can they take the arrears from my claim before they pay me????????????:confused::confused:

I seem to be reading that some people are sending a 3rd letter to their bank, before court action. It reads something like: 'Unsatisfactory response....will be initiating court action in 14 days' etc.
I've already sent the first letter (usual response) and the second letter (no response)

Am I right inthinking that Lloyds have just won a case that someone brought to claim their bank charges. If this is the case should I still send my court letter or back down gracefully, bearing in mind that if it went to court and they turned up I would have a clue what to say in my defence and wouldn't be able to speak anyway as I'd be scared sh.....less.

I posted this a couple of days ago and didn't really get an answer so have bumped it up again.Reading the threads since,do you think I would be better going through the ombudsman.I sent our pay up or court letter to Lloyds on 2nd may and havent heard a thing.

I think the general concensus is to carry on with your claim. The case you mention is the one where the guy claiming didnt prepare his paperwork properly and didnt have a copy of the T & C !
If you have a look at the success thread, Lloyds have paid out on numerous cases since. and only one victory ( that we know of) and have paid out on many, many others previously.
I too am claiming from lloyds and this one case is not going to put me off!

If you really dont think you can do it yourself then ask the FO to look into your claim for you.

    GOOD LUCK

    hi
need some advise been trying to claim charges back from lloyds since march
due to missing statements(still missing) but after third letter got the standard
offer of £750. My question is shall I just accept it or go for the full amount
£1038.86 including interest. Since the case last month I am not sure what to
do, my other option is to go to the fo to try and get the rest back.
    suggestions would be great
    thanks inadvance

Depends how much your claim is (without interest) The FO does not award interest so at best they can only get charges amount.

Also depends on the amount you are willing to settle for- only you can decide that!

    Good Luck

I have spoken to my local court this morning who advised me that its now up to the Judge if they send out an AQ and MCOL have advised them not too and my court date will probably be in September.
