Hi there, just out of interest, has this happened to anyone...
I started my claim against LTSB on 1/3/07, by requesting statements, and sent the cheque for £10.
Approx 2 weeks ago, I received details of (my) charges I know nearly 3 months later!
Anyway, today I have received 2 more copies of bank charges, one is of mine and the other, someone elses!!! On closer looking at the origional set of charges, these too where not mine!!!
So i'm sure this is against the DPA, so wondered if anyone else has had this, or should i report this to someone?
In brief.. All 3 sets of charges came addressed to me and only 1 is mine..0 -
I have tried to claim over £700 for my brother and got the usual "go away" letter. I want to take it further but have no idea how to go about lodging the court proceedings and how much they will cost. It will need to come out of my pocket initially..... For 'low' amounts such as this, is it worth the hassle?0

You could report id as a DPA breach. Personally, a little underhand I know, but I would use this massive error on their part as leverage to get them to pay up!0 -

Im not sure what will happen now, the letter i recieved from Money claim said thay had got till 9th June to respond, is this the response?
Any advice will be greatly appreciated :T

I'm at the same stage as you, Lloyds have until the 9th to defend my claim as well!! Lets hope they're busy that day and forget us. Keep me posted........Mel :heartpuls0 -
Am I right inthinking that Lloyds have just won a case that someone brought to claim their bank charges.If this is the case should I still send my court letter or back down gracefully,bearing in mind that if it went to court and they turned up I would have a clue what to say in my defence and wouldn't be able to speak anyway as I'd be scared sh.....less.0

Do you know what..I have just returned to this great website after a while off and I have been reading all the posts from today about reclaiming our money that Lloyds took form us.
My story is as all of yours abouve but with the exception that I called the Financial Ombudsmand two weeks after I sent the second letter. I did not relish the chance that it would get to a court so quite innocently I called the Ombudsman to complain and they took me through the process of them going direct to Lloyds and yesterday I finally got full settlement of my £1200 claim.
Yes, I did get the mandatory £750 paid into our account and I did like everyone else write back to them to say that it was accepted as part payment. This payment was made after the second letter was sent. It was then that I contacted the Ombudsman and they have been fantastic. Within a week they wrote to me, got us to complete a couple of forms ( I also complianed about the constant telephone calls to our home in the evening) and we sent back with a list of our charges and dates and that was all we had to do. They kept us informed and within 6 weeks I have had it all sorted. And they stopped calling us...So I have to say that people who are past sending the second letter..get onto the Ombudsman and get your money back..They have been a revelation and we recieved the balance yesterday into our account.

Yes it looks like we have the same accounts with same people i just wanted to let you know that i got though to lloyds andover on friday at 9.30am i think it was the same number you have but Sorry i left it at work (being cheeky used works phone) My advice is if you dont get though the first time, Keep trying.;)0 -
I am trying to claim bank charges back from them for £800. I went through the first process of getting my statements, received them no problem. Then i sent them the 2nd letter asking for the £800 charges back, i sent this letter out to them on the 10th may and this is a letter i have received..

When a customer doesn't have enough in their account to cover a payment, this always means additional work. We must either make the payment for you via an overdraft or send the payment request back. Either way, it has to happen speedily. We feel it's only fair to charge for the extra work involved.
Of course it is only fair, too, that we're completely open about any charged-for services before you take them up. You've mentioned the new guidelines from the Office of Fair Trading on credit card default charges We don't agree with the OFT's thinking on this and we're still talking it through with them But the important point is that the guidelines only concern 'default' charges. The fees we charge for going over an overdraft limit and for returned payments are not any kind of default penalty. They are fixed standard prices for the service we provide in these situations. So according to our legal experts, the OFT's guidelines on credit card default charges do not in any way apply. I do hope you can see that we make our charging system as fair as possible - and why I cannot agree to cancel your charges.
I understand that you may also have some concerns about us sharing information about your relationship with us with the credit reference agencies we use. I'd like to reassure you that thid does not apply to bank charges. we only share what is known as white data, which is information about paymeants to your credit card, loan, or mortgage payments.
I do hope you can see that we make our charging system as fair as possibleand why i cant agree to cancel your charges.
If you have asked for copies of you statements and paid the £10 fee we will send them to you within 40 day limit set b the data Protection Act.
I hope this fully answer the points you raised with us. Please let me know if there is anything else i can do for you . if we cannot come to an agreement , i will provide you with the details of the Financial Ombudsman Service so they can consider your complaint independently.
If you are happy with the way i have dealt with your complaint there is no need for you reply to this letter

Why not change to an Alliance and Leicester Bank account? It's really easy they do it all for you, I have gone from paying £10 a month account fees and overdraft interest plus dreaded charges on a £3000 overdraft they told me I needed! To clearing the £3k with a intesrest free credit card (now only £600) and have a account with A & L with a free £250 overdraft which I have taught myself not to use unless life or death (or unmissable social event
) Martin recommends A & L at the moment, and I can recomend you to the bank that way we both get £50 lol. (just a thought:rolleyes: )

Its a very well written letter, but still the usual load of SOB (Standard Operational B*llsh*t).
These days, your chances of getting all your charges back in response to a strongly worded letter are as slim as a size zero model. The first two letters are just to show that you have tried to settle the matter before you escalated it to the courts or Financial Ombudsman.
You now have to decide whether you want to start a court claim or refer your claim to the Financial Ombudsman.
