  • Hi,

I have a select account with Lloyds TSB meaning I pay a £7 a month account charge yet I now realise none of these benefits are remotely worthwhile to me. They offered me the upgrade when I was 18 and had a very good credit rating, but over the past five years I have found myself in financial difficulty due to long-term ill health with absolutely no understanding forthcoming from the bank whatsoever despite attempting to communicate with them in regards to my situation on numerous occasions, which incidentially is what the advisors always tell you to do, to no point.

Anyway the upgrade gave me a £100 overdraft facility (they tried to offer me more but I rejected) because I didn't require it at the time, and a credit card which I never used for about a year. Then my health problems started and I had to quit working and ended up having to live on the money I had in the bank and by paying for food on my credit card. I wasn't an irresponsible spender and I'd never even considered using my credit card up to that point, in fact I had never been close to being in debt.

So now I've been stuck in my overdraft for the past year after finally running out of money, but this £7 account charge keeps taking me over my £100 limit and I am continuously being fined for it (yes I am in the process of reclaiming these horrendous charges). I want to tell my bank I that would like to go back to a current account so I don't have to pay this £7 a month fee anymore but I can't live without the £100 overdraft facility right now but a current account doesn't offer it.

What can I do, had anybody gone back to a current account and kept the overdraft facility of the select account? Please advise and I thank you in advance.

Why not change to an Alliance and Leicester Bank account? It's really easy they do it all for you, I have gone from paying £10 a month account fees and overdraft interest plus dreaded charges on a £3000 overdraft they told me I needed! To clearing the £3k with a intesrest free credit card (now only £600) and have a account with A & L with a free £250 overdraft which I have taught myself not to use unless life or death (or unmissable social event ;) ) Martin recommends A & L at the moment, and I can recomend you to the bank that way we both get £50 lol. (just a thought:rolleyes: )

Just wondered if anyone has had this happen, just checked my lloyds acc and they have not taken the £190 charges out, so i called to ask what was happening as didn want to spend money if it wasnt mine, trying to be good!!, they said that due to a complaint logged on 15th may (which i assume was my court info as they were served on this date) they have prob waved my charges(i didnt ask them to) as they could not take charges out after the 1st anyway, how strange but how lucky

I have now been to the court and started my proceedings against (unfortunately )Lloydstsb. I have followed all tips to the letter, having had no reply to the final stage letter before court. My papers hopefully will have been served by Monday next. I am 63 years old, disabled, find it very hard to make ends meet and discovered I had £3550.15 in unfair bank charges. I was treated with the greatest respect at the court and found to my delight they waived the charges of £120.00 as I am in receipt of pension credit, come on you guys in similar circumstances give it a go. Good luck to me ha ha and everyone else in circumstances like mine. Marie

go for it and good luck!

... sent me a letter offering me £750 as full and final settlement, this is what I sent back:

Thank you for your letter dated 27 April 2007, which I received on 2 June 2007 (postmarked 1 June 2007) regarding my claim. I am writing to inform you that I cannot accept your offer of £750.00 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance.

Please also note this payment has not yet been received and it is now 14 working days late. I will require a cheque payment as I have now closed my account with you.

I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges+statutory interest+court fee.

I'm sure they just made a typo with the date, but I thought I'd point it out to them (I'm such a b!tch sometimes!!) :rotfl:

Hi, all got a letter back from Lloyds today saying:
""Thank you for getting in touch with us. I am sorry you are unhappy over your account charges. Like any business, we do make a charge for some of our extra services. When a customer doesn't have enough in their account to cover a payment, this always means additional work. We must either make the payment for you via an overdraft or send the payment request back. Either way, it has to happen speedily. We feel it's only fair to charge for the extra work involved.
Of course it is only fair, too, that we're completely open about any charged-for services before you take them up. That's why we take care to provide every new customer with the latest guide to our charges. You can also get up-to-date details about fees and borrowing rates at all our branches, via our helpline and on our website.

Just as importantly, we do everything we can to help our customers avoid charges altogether. I'm sure you'll know how easy it is to keep a running check on how much is in your account. You're free to get an up-to-date balance at any of our cash machines, over the phone, online and nowadays even by text to your mobile.

If you know a payment is going to take you over the limit, you're welcome to see if we can raise your limit - and we can usually give you an answer straightaway. You might know, too, that we don't usually charge fees if it's the first day in 12 months that you've gone overdrawn without agreeing it with us beforehand. And we never charge an overdraft excess fee more than three times in any one month, however many times you go over your limit.

You've mentioned the new guidelines from the Office of Fair Trading on credit card default charges We don't agree with the OFT's thinking on this and we're still talking it through with them But the important point is that the guidelines only concern 'default' charges. The fees we charge for going over an overdraft limit and for returned payments are not any kind of default penalty. They are fixed standard prices for the service we provide in these situations. So according to our legal experts, the OFT's guidelines on credit card default charges do not in any way apply. I do hope you can see that we make our charging system as fair as possible - and why I cannot agree to cancel your charges.

This letter is the bank's final response, which means that if you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter. I have enclosed their leaflet that outlines how to contact them.
Thank you once again for taking the time to raise your concern with us.

    Yours sincerely

Now am ready to send the 3rd letter over to Andover(Debbie Gilbert), mistake i made in the 2nd letter was i added O/D interest which was 0.16 have been reading around and see that i can't that, can i know take that amount out before i post the 3rd letter?Amount am claiming is £505.

    Thanks Den

Received my letter back from tsb.

They started with saying that this is a service and that it does cost them money - bla bla bla.

I never received there infor on where each charge comes into there T&C.

I also may look down the ombudsmen after bbc news this morning - how do u no this.

Is it worth me contacting tsb asking where it says it is a service charge.

    cheers in advance.
