Hi
I have come to the conclusion that Lloyds TSB must be the worst bank for dealing with the bank charges based on the forums on this site.
I must admit I'm not having much luck with them at the moment.
I sent for my charges which they sent sumerised for me.
I used the calulater and sent off the first letter on the 14.april 07. with the print out of the charges and interest showing.
Never heard anything so I sent the second letter offering to settle at a lower amount. I sent this on the 3rd may.
I received a letter from my bank manager dated 3rd May saying that the service recovery department are extremely busy with the amount of claims and they were trying to settle within 4/6 wks after receipt of letters and that my original letter should be responded to before the month end.
He was keeping my second letter on file till they had made their decision to avoid duplication.
I rang yesterday 1st June on the general num to either be put through to the recovery dept or my local branch as I was told they don't hold a number for that dept or have an address to give me. All letters that come through of this nature get passed along in the internal mail system.
So now I'm not sure what to do because I don't even know if they have even received the first letter yet and if they have they are in breach of the complaints procedure in which they should have acknowledged mu letter within 5 working days.
Can someone advise me please if the next step for me is to take them to court now especially as I've not any response from them at all?.

Yes, Lloyds are full of applying stalling tactics, I would start court action else you'll be waiting forever for them, good luck,

Hi, Please can anyone advise me as what to do??
Since Feb I have been reclaiming charges from Lloydstsb. Ive done all the template letters from this website, and had no luck. I have then gone through Moneyclaim to take them to small claims. Today ive recieved a letter stateing " I am unable to add to the letter dates 12/4/07. This is because we have already outlined our position on the points you raised.
We see from our records that you have already issued a court claim and our solicitors are dealing with this. theres nothing more I can do to help you at this stage" - Jon Willis
Have I lost my battle??
Im not sure what will happen now, the letter i recieved from Money claim said thay had got till 9th June to respond, is this the response?
Any advice will be greatly appreciated :T
Thanks

am really miffed now! have sent of first letter about a 2 mouth ago detailing my claim charges, dates and total = £4498, and was told at the 2 week stage that it would take about 40 days. so i waited..... and waited and still nothing, are they stalling for time to change the so called charges into something else to stop people claiming? do i wait for a reply or just send the 2nd letter? has anyone else had this problem? by the way has anyone won a case with ltsb since the court case?0

Hi, they did that with me, just send the second letter. It states how long you give them, so crack on!!!
Good Luck0 -
No, this response is from Lloyds TSB, not their solicitors, who are now handling the claim.
When your claim moves from the letter stage to the court claim stage, everything does slow down and you do lose the complete control you had before. Just remember that “the wheels of justice grind slow, but they grind exceeding small.”
Your claim should have been issued by the day after you filed it. The court allows 5 days for it to be "deemed" to have been served. The banks solicitors then have 14 days to respond. However, their response can be just filing an "acknowledgement". If they do this, they get another 14 days. If they file a defence, the case will be transferred to your local county court and a date set for the hearing. If they don't file a defence and when their deadline expires, you can apply for a judgement by default via the MCOL website.

Hi sorry i'm not an expert but after reading a lot on this subject (getting ready to start my claim with lloyds) think you should stick with the time limit you gave them in your letter. It looks like it's one of banks ways to delay the process. Good luck, keep us posted. MrsDOfficial DFW Member no:4100
