He was lovely after that - i said my friends a solicitor so i dont wish to hear you telling me its not the case i Have judgement 9th may therefore 7 days from that it should be in in my account today and it isnt. he then took all the case details etc and was really nice - told him i know the crack and that banks are taking peee in paying it back to us when there quick to take it out of our account - he ended the call saying so just to clarify you are £16 over your over draft and i said yes thats correct and just to clarify you owe me £3393.06!!! lol oh also clafified they were NOT charging me any further charges and any charges / interest etc had been frozen until further notice!! result

  • I sent of my statement for refund of charges to TSB for £525.00 .

I received a letter this morning from their complaints department saying they have acknowledged my complaint.

What I dont understand is why are they saying its a complaints when I havent complain if you no what I mean.

    Is this standard practice?

    Any advice would be appreciated.

When I submitted my claim to MCOL in the 'claim particulars' I only wrote a breif statement saying that I wished to claim back charges which were unfair and disproportionate. Now I've read a few more posts I think I should have put much more detail in! I thought that I would only need additional information if and when I had to appear in court. Having read a few more posts I am now worried that if I have not been specific enough the claim will be rejected... can anyone help???

    Hi
What I done was to send them details of the claim with my list of charges to the court (2 sets) with the letter below and one set to Lloyds TSB with a covering letter pointing out that this is what I had sent to MCOL and asking them to put the details with the claim.

I got this letter off the 'The Consumer Action Group community' web site:

    The Court Manager,
    Money Claim On Line
    Northampton County Court
    21-27 St. Katharine's Street
    Northampton
    NN1 2LH

    Dear Sir/Madam

    (Your Name) –v- (Bank)
    Claim No: ********
    Date Issued: xx/xx/xx

Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

I respectfully request that the enclosed schedule should be attached to the particulars of my claim.
    Yours sincerely,

    I hope this helps

Yes, often the banks refer to it as a 'complaint'

With the Judge Cooke coming from Mars, can anyone give a real account of what happened to them when you got to court and the ruling went in your favour.
Did a defence team turn up or was it written and sent to the Judge?
How did the Judge sum up the case if he found in your favour?
What evidence and wording did you turn up with?

I ask these questions in hope that the answers will provide the impetus for people to carry on with their cases.
    Keep right on!!
