set aside is just a legal jargon they use to try and make us think they can get it overturned when in fact all it means is that they will write to you to ask if you are willing to get the judgement removed once they pay you - normally they send you a kinda contract letter thing stating this you sign it send it back and they pay you the money but are then able to get there judgment removed from there namebeckandbryn wrote: »Hi all

Well today I went into my branch and showed them my judgement letter and asked where is my money?
After keeping me waiting 1 hour the lady said that she has faxed a copy of the judgement letter to Sechairi, Clark + Mitchell as apparantley they havent recieved their copy from the court. She then asked the branch manager if there is anything they can do and he has said no, I need to contact the solicitors.
I got homeand rung the solicitors asking to speak to Peter Jones but of course he wasnt available.
I did get to speak to a lady who said my claim has been put aside and will not be dealt with today, and she couldnt tell me when they would deal with it. I explained that the judgement states the claim must be paid by today 16th May and if its not I told her I would take enforcement action and go to the court tommorow to set a warrant of execution so the bailiffs can recover my money. She first said that the judgement when they do deal with it will be sent to the bank to see if they will pay, I said that has judgement has passed they dont have much option but to pay, and she says they could get it set aside? (Does anyone know what this means?) I told her again that I will get enforcement sction tommorow and She didnt seem too bothered and told me to go ahead. So this is what i am going to do.
Has any one else got this far and got the bailiffs to recover their money? How long do you think it will be before I get my money?

my friend said they are using this phrase to try and confuse us when what it means isnt what they try and make us belive
my mate (who works in solicitor) said if they refuse to pay up then you go straight to enforcement - they may then pay pre bailiffs getting there but if you dont do this it will drag on for gods knows how long
she dealt with same senario for a friend who was dealing with barclays claim who sent there letter asking for it to be set aside within 4 days of judgement and paid in money within a week of him returning signed form
lloyds are a bunch of complete tw*ts

hi just wondering if anyone can help me? i'm going through the court stages with Lloyds tsb and my claim has been defended. I really cant be bothered with them dragging this out and wanted to know if anyone knows if it would be ok to write another letter asking for them to settle out of the court for say £950 when i am actually claiming £1044,if this is acceptable where do i send the letter? and can anyone help me out with what i should write? after what happened yesterday i would really prefer to try and get them to settle without going to court!!

you could do but really your wasting your time - just read the comments on here - its never worked yet - court stage is only way forward to getting money of any kind (unless they offer you the random 750quid they seem to offer the odd people)
i really dont think you've got any chance of settlement by writing a letter especially when its only 94 less you want.

Hey sounds like my bank account, I am at the same stage so guess no going back now, LLoyds say i have more money going out og my account then going in, fair point, so have made an effort to stop using cheques etc, but they charges me so much that of course i have more going outthat coming in, this really infuriates me, they sy they there to help but they dontm i asjed for them to stop chargin me for cpl months so i could try and sort account out, bigg NOOO! makes you laugh don it, just tryin to keep this acc half decent so i should i win i get get the money out without them swallowing it in my debt, then will prob walk,0 -
I've been making a claim on my son's behalf for £1600 from Lloyds TSB. Have made the claim on MCOL, which was issued on Monday. In light of their recent victoryI'm really worried about what information I will need to get together for court and what form of words to use. Can anyone direct me to a link which would help, as I don't want to be defeated on a technicality, I'm sure TSB probably won't cave in at the last minute any more!

I received my letter from L.TSB with this statement which seems to differ from the ones I have read.
“The Office of Fair Trading has published new guidelines on credit card default charges. We’re still talking it through with them, but the important point is that the guidelines are about ‘default’ charges that people pay when they break an agreement with us. This doesn’t apply to your charges as these were dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven’t broken your agreement. They are our prices for the service we provide in these situations”.
Why would I agree to go over it, it just went over and they charged me
Does the main I have no chance?
Should I send in my second letter?
What happens if they charge you again while you have already sent the first letter with first amount?
Just a little help please if any could just give me some advice

wrote to lloyds about a month and a half ago asking for statements which they sent me fairly quickly along with a letter quoting at the end you may now wish to reclaim your charges (is this a good sign ) anyway i sent copies of the highlighted charges from the statements totalling about 900 pound to my local branch adressed to the branch manager i also included the letter where is said i may now wish to reclaim my charges and highlighted that too!! anyway that was about a week ago ive just this minute recieved a letter from the recovery center in andover it begins with a thank you for getting in touch and sorry to to hear that im unhappy it goes on to mention guidelines the banks follow and the agrreements on accounts and such like it is only on the second page that it says we cannot agree tocancel my charges it then goes on to say about requesting statements and if im unhappy to contact them so that i can get details from the finacial ombudsman to pursue it
i guess my question is this is this letter standard issue as i dont know what to do next for a start im not happy that i received this letter from a diffrent dept and not who my statements and request for my charges was not answered by my branch manager i just dont know what to do next please help0 -

I got the same i have posted the same quote here but i'm yet to get any help... but i assume it's just different wording a way to get out of it so i just went ahead and sent a second letter threating to go to court, i'm not sure if with this letter we can not continue or if the bank has found a way to stop us from claiming.
please please someone help us.

cheers jimbob i think if anything im more annoyed i didnt get a personal responce from them i think i was at least expecting a letter from the branch manager as that was the person i sent statements to, who do i write another letter to now tho my branch manager the recovery center or somebody new gees these banks are horrible i think they are operated by darth vader or dragons or something lol any help would be most welcome0

All banks have set up departments to deal with these "complaints" its very unlikely that any branch manager will be in a postition to deal with this.
