    As Martin says in his blog, there are many reasons why individual cases are won and lost and will not neccessarily have a bearing on future judgements,

    If a claiment is not fully prepared, does not understand and argue the premises that the case is being brought to court on or makes errors on what can or cannot be claimed, the judge will have no choice but to make a ruling against them, because it would be easy for the bank to win at appeal on a technicality.

    A case presented differently is likely to have a different result

    I do not think that the banks at this stage will start going to court in a big way until there is something more definitive, otherwise they are very likely to get their fingers burnt.

    However of course they will try and use this case as propaganda, as they use every opportunity to confuse, delay and cause anxiety.

    Lets just press on. Nothing has really changed. And good luck everyone

    I think that if it was so easy for the banks to win and set a precedent, they would have done it long ago - this case, like Martin says, is probably a one-off!

    Hi all
    Hoping someone can help me on what to do next.
    I went to court against Lloydstsb (sechhari, clark + mitchell solicitors) on 2nd may2007. Judgement was awarded in my favour as the defence didnt turn up and the judge says they have 2 weeks to pay.
    The 2 weeks is up at the end of today and up to now they havent paid.
    I have rung the bank on the charges line and can never get through. It keeps going to please leave a message and then the mailbox is full, then I have also tried to ring the solicitors a few times, and all thay say is they need to pull my file and will ring me back, but they never ring me back.
    Has anyone else got to this stage without them paying?
    What do I do now, should I ring the courts and instruct them to send the bailiffs. If I do this how long will it be until I get my money (£656.44)
    Hoping some one can offer me some advice

    This is just a thought. Have you checked your account. I received a payment from LLoyds and only discovered it because I looked at my online account checking whether I had received my backpay from work.

    It was another week before I received a letter. And then it was from the solicitor and not the bank. I have not received anything officially from the bank.

    You may be expecting a letter of confirmation that you have received your money but it doesn't necessarily work like that.

    Hi I have just recieved details of the charges from the TSB. They have only gone back 5 1/2 years, the letter they sent ststes that if I want to go back the full 6 years they will have to go into archives. I will also have to wait another 40 days for details of the charges. Can I demand that they send me details sooner than this ?

    hi just wondering if anyone can help me? i'm going through the court stages with Lloyds tsb and my claim has been defended. I really cant be bothered with them dragging this out and wanted to know if anyone knows if it would be ok to write another letter asking for them to settle out of the court for say £950 when i am actually claiming £1044,if this is acceptable where do i send the letter? and can anyone help me out with what i should write? after what happened yesterday i would really prefer to try and get them to settle without going to court!!

    they only gave me 3 years worth of statements therefore I just doubled it and said since they had failed to provide the full 6 years, despite waiting since January and numerous phone calls and letters to request them this was my only option. I would divide your total by 11 to get 6 months worth of charges then multiply by 12 to get 6 years worth!!

    Can anyone help please I have successfully claimed on 2 accounts against the nationwide both having to issue court papers and both saying they would defend and then in the last week pay up.
    I have gone through the same proceedure for my Daughter against the HSBC but have received no correspondence from them at all issued court papers which they said they would defend the 28days are now up but still no payment or coresspondence what do I do now

  • In the process of reclaiming back charges from Lloyds on 2nd letter now, 1st letter with statements sent to Yorkshire, both sets of charges add up to £644. Saw Martin on GMTV this morning, I would have been angry too, the women sitting on the sofa next to him talked rubbish, banks don't want to listen only there to make money out of people who can least afford charges.
    Hope to hear soon from Lloyds, wonder what excuse they will use this time.
