    have recently sent a letter to lloyds claiming back £800 they said no so i sent the next one saying they had 14 days to respond but they never did. do i send another letter or what do i do now????
    Also MBNA have been more than 14days after the letter asking for the charges of £300 back , do i send the one threatening court action already or wait abit longer
    any help would be great thanks x

    Can someone please advise with reference banks (in this case Lloyds) claiming that default charges are not repayable as they are prices for their servis?
    I would be most grateful for some answers/experiences with regard this subject.

    Is anyone else experiencing problems in getting through to Lloyds in Andover , the 'base' for dealing with charges complaints ?
    I had a promising conversation with them (Howard Callanan) on April 13 following my initial letter requesting refund. On the strength of that call, he assured me that a 'review' would be instigated and that I would almost certainly get a payment / goodwill gesture within 3 weeks. He also assures me that this payment was in no way final and would not prevent me from pursuing the remainder (just short of 3000). I was encouraged. He also told me I could call and speak with him at any point.

    However, I have been unable to get through to the Andover centre for the last three days because they are overwhelmingly busy lying to customers. A US automated message comes on offering to take details and a callback but hastily adds that in actual fact, it can't because the person's mailbox is full. It goes on to suggest pressing 'hash w' which is really not helpful in the UK.

    Any takers ??

    Have issued court papers on the 11/5 to Lloyds-TSB for one account at £3,000+. Today received a letter dated 4/5 but posted 15/5 offering £750 between my two accounts as a final offer, no mention of court action and that the sum will be put into my account in the next 10 days. Have just checked and £375 has been put into each of my accounts today. Have transfered both amounts to savings account so that any overdrafts etc don't use it so that they could say I have excepted offer. What should I now do.

    Well today I went into my branch and showed them my judgement letter and asked where is my money?
    After keeping me waiting 1 hour the lady said that she has faxed a copy of the judgement letter to Sechairi, Clark + Mitchell as apparantley they havent recieved their copy from the court. She then asked the branch manager if there is anything they can do and he has said no, I need to contact the solicitors.
    I got homeand rung the solicitors asking to speak to Peter Jones but of course he wasnt available.
    I did get to speak to a lady who said my claim has been put aside and will not be dealt with today, and she couldnt tell me when they would deal with it. I explained that the judgement states the claim must be paid by today 16th May and if its not I told her I would take enforcement action and go to the court tommorow to set a warrant of execution so the bailiffs can recover my money. She first said that the judgement when they do deal with it will be sent to the bank to see if they will pay, I said that has judgement has passed they dont have much option but to pay, and she says they could get it set aside? (Does anyone know what this means?) I told her again that I will get enforcement sction tommorow and She didnt seem too bothered and told me to go ahead. So this is what i am going to do.
    Has any one else got this far and got the bailiffs to recover their money? How long do you think it will be before I get my money?

  • hi, on saturday i received the £750 offer letter and on monday the money was in my bank. if i take this further and ask for the full £1400 im asking for is there any way they can take back the £750? thanks
  • I added that into my amount the £25 charge they charged every month you were 'naughty' but not the debit interest.
    It adds up to alot more you will find too

    Barclays wrote to me after Judgment threatening to put the matter aside and
    asking me to write to the Court withdrawing the case.I issued warrant with Northampton which was sent to London Court on 20th April. The Warrant has not been executed. The bailiff says he has received no details from the Court to execute the warrant.
  • hi everyone.
    i have put my claim in on MCOL just waiting for a reply from LTSB. i am abit worried now. i am claiming over £3200 and my partner £3500. we have been in a mess with our bank for a while. lloyds take a monthly amount of just over £300 of both accounts, all due because we cant afford the charges every month, we in a horrible circle we cant get out of. was really hoping an still hoping we would get these charges and upto date charges back. i am still contiuing with what we doing, but am so scared.
