I did recieve the charge in my name directly to my address, I dont know if they did contact my ex employer, what I'm worried about is if they did contacted them and they told them that I was driving the car at that time, then that proves that I was driving at the time of the offence

!!!!!! it's not an "offence" & they won't be "taking action".

It looks like your former employers as the registered keeper of the vehicle have been sent a Notice To Keeper inviting them to pay the charge or inform APCOA who was driving so they have given your name & address.

Well if they are writing to you they cannot go back to them. And why are you worried ? What do you think happens to others who drive vehicles ? This is just an invoice asking for payment, they can't demand anything despite what it says on the letters.

And debt collectors and solicitors will write next if you don't appeal, these powerless companies again can't force you to pay as they are powerless, they just write letters with outrageous demands that can be ignored.

And again this is NOT an offence !

We know you got the letter in your name now - and we are simply telling you that you need to respond, you need to appeal in order to hook all future letters in your direction. It is a GOOD THING that your former employer gave your details, that's what they are supposed to do!

The point being that some idiotic companies just pay the things then charge the driver = WRONG.

But I would say you need to appeal so that you can permanently hook the letters in your direction and also so that (if in England/Wales) you can get a POPLA code (see top threads please).

So challenge it, either like Stroma suggested,

or like this (only I expect your letter is a Notice to Driver but the same point applies, it needs to state the creditor):

    http://forums.pepipoo.com/index.php?showtopic=78723

or like this; a strong legal challenge giving no info at all but a valid challenge nonetheless:

    http://www.parkingcowboys.co.uk/appeal-letter/

HTH - it's your choice, a soft appeal or a strong legal challenge. And then read the threads here about POPLA because that will be the stage of appeal that you will most likely win if you start a new thread please and ask for help to word the POPLA appeal. THIS IS A SCAM, NOT A FINE AT ALL.

There was no offence. the fact that your ex employer has passed on your details is a positive one, as on the other hand they ( your ex employer) could attempt to take the money from any wages due, or bill you somehow any way.
As there was no offence APCOA can get stuffed, for want of a better phrase.

Did the Apcoa signs have something on them saying "for all terms and conditions, please see website"?

If so, they won't do court, after-all how are you meant to agree into a contract without being able to access all information, for all you know there could be a Term on the website which says "all blue cars will be charged £5000"

    Ignore Apcoa, they soon go-away
  • Hi All,

New to the forum and have read some of the posts in this thread but wanted an up to date response on whether to pay the £80 charge (£40 in first 28days). I went to drop off my daughter near the coach drop off point but was not aware that i couldn't go there. This was in early april and we got the notice in mid may. Should we pay this?

Please start your own thread. Each case is different & so will be the advice so we don't want different cases to get mixed up. If the notice through the mail was the first that you heard of this charge then I can immediately see one very good reason why you are not liable for this parking charge but we need to know the details & see copies (both sides) of the letter with all details that will identify you & the parking event removed.

Of course you don't pay. Happy reading, then start your own thread about appealing this and winning at POPLA if it was in England/Wales. :)
