Hi everyone thank you so much, sorry I have not been on, I have been in hospital again
luckily baby is ok though & we found out its a girl as they finally gave me a scan!!!
Thank you for all your concern, you are all so lovely it makes me feel very humble.
I did manage to send offers of £1 to my creditors last week using the template letter of CCCS website.
3 creditors have replied so far 2 accepting my offer but Barclays have refused on an overdraft of approx £2300, they say that my 'Offer would not allow the debt to be repaid within an acceptable period of time so my account is being terminated & will be referred for recovery action, an agent appointed by the bank will contact you directly to discuss your offer and repayment of your debt' does this mean they are going to take me to court?

Some creditors work on the basis that they insist a debt is paid within 6 years. Barclays may take you to court, and would probably end up with a CCJ paying £5 per month. If you've have not made a mistake, you've made nothing0 -

Not necessarily, but if they do, you can only pay back what you can afford honey. Remember this though You are not alone, most of us Debt free wanna be's have been where you are today. There's always light at the end of tunnel, and everyone on here will show you the way. (p.s. Barclays and Barclaycard are notoriously obnoxious about settlements, so be obnoxious back, it sometimes works!)

            Hi Vicxzy.
Glad to hear you and your unborn Baby Girl are ok. That is absolutely the most important thing at the moment. How is your OH and the dog. Did you tell your OH about everything.
On the other points -
Good news on your 2 creditors that have accepted the token payments. :T
Have you conacted one of the debt charities (CCCS or Payplan etc) for advice yet.
If you go down any of the DMP, IVA, Bankrupt routes an offer of pro-rata payment will be made to all your creditors. You may then find that Barclays accept that payment. You will probably also find that Barclays have sent you just a standard letter. Just keep sending them token payments as with the other creditors. If and that is a big if it did go to court and the judge can see you are trying to make an effort it will bode very well in your favour.
Keep taking one day at a time.

Thanks guys, Barclays have by far been the worst, Barclaycard have hounded me by phone for the £16 in missed payments that I owe so many times a day I will be getting a cheap sim as soon as I'm well enough, I owe Egg £900 in arrrears & even theyve not hounded me so much!
I finally plucked the courage up to tell OH & he was great, thank you so much for convincing me to do it, it has relieved a bit of the pressure.
Can someone please tell me if I got a CCJ what would it mean & if I had to pay say £5 per month would that be until it was paid off in total? I owe roughly £35k in total.
Thanks guys x0 -
A CCJ is issued by the creditor against you, the court will send you a plaintiff form, which you complete, you list down your income against your expenditure, including all your bills, then make an offer on what you can pay, i.e. £5.00 per month, if this is accepted this is then paid to the creditors monthly on the date set. This is a legally binding Contract set by the court, and if you miss payments it will go back to court. These last for 6 years on your credit file. Obviously this will have an adverse effect on your credit file. If you look into doing a DMP/IVA this may help as creditors are less likely to issue a CCJ if on a plan.DFW Nerd no. 1191;)Maximum Debt £33k in 2007  all on CC's (I know, lesson learned; never consolidate and not cut up the cards!)Now completely debt free, but it was a double edged sword

Individual Voluntary Arrangements/Debt Management Plans are instigated by third party companies, try www.CCCS.co.uk they are free and will do all the negotiating for you.
