Nice one Smudge, I knew it was worth pursuing - I thought this would be the result.

I still don't know why Apple didn't help from the start, especially as the police got involved and they still did nothing. At least it was finally sorted and Apple saw sense.

Congratulations! I've read this thread with great intent and couldn't quite fathom Apple and the Police's response throughout, but gosh if one thing has come out of this thread it's how great Vodafone's customer service is - so huge +++'s to you guys and I'd definitely consider switching to you when my contract's up.

The other thing I wanted to ask Smudge - if you knew the phone was being repaired the second time, and at what store and what time - why didn't you just go in at that time, tell them who you are, phone's IMEI etc and get it yourself? You were, as Apple told you, the rightful owner...

The reason I couldnt go there was because i live in Birmingham, and the phone was being repaired in london, I only got the email, 1hr before the repair was due to take place, I didnt know the imei of the exchanged handset, only the serial of the handset.

    Great news and great thread.

Glad you got sorted. If Apple are still reading. Add another potential customer that will def avoid your company. Absolutely shocking behaviour.

OP any chance you'll be able to post some of the transcripts now it's been resolved?

    Well GOOD NEWS!!!!!

Sent Letter before Action, also offered them ADR - Alternative Dispute Resolution.

No reply, until senior managers have agreed to send me a brand new iPhone 4, as they cant return the original iPhone.

So Result, even though it took plenty of calls, letters to get to this stage.

Must thanks everyone for their advice, especially Lee from Vodaphone, and private messages, which gave me legal advice, so many thanks everyone.

    Hi SmudgeUK,

Just seen your update here with this great news.

Glad I was able to help out along the way.

Take care and if you ever need any further help in the future you know where I am.
