Well another blow now,
Police say they cant go storming in for the phone, cause of evidence on wether Apple knew when the phone was stolen, and told me that if they refuse to talk to me, or give/replace the phone then i have no choice but to take them to small claims........Awaiting Inspiration......................0 -

Strange they can recover stolen vehicles from driveways, then !
Seriously, they can demand from Apple the name of the person who exchanged the phone. Why they won't I don't know.
There is no proof that the person above was the thief, but they should be able to show where they obtained the phone from.
The real point is that it seems that it is too much hassle for Apple and the Police for a relatively small value item in crime terms. Your small claims court case is likely to fail if Apple have dismantled the phone or scrapped it and, since it isn't a crime to sell an Iphone or compulsory to re-register ownership when you buy one second hand, Apple can reasonably claim that they acted in good faith.
You could make a formal complaint to the police if they are not prepared to ask Apple for the seller's details and follow it up, of course.0 -
There's a possibility that Apple continued to handle your phone after they became aware it was stolen, but this is much more difficult to prove and won't necessarily help you get recompensed.
Well in that case, may as well forget small claims, and forget it all because the police arent after the guy who brought the phone, they arent interested, and that came from the DS who is dealing with the caseAwaiting Inspiration......................0 -
Why don't you go forward from a PR point of view, contact your local TV news and newspapers and even the consumer columnists in the national press and start publicising the "apple handle stolen goods" angle.
You might get a goodwill offer to sort the problem.====0 -

This sounds awful, feel sorry for you mate. Next time, buy insurance especially for such a premium costing phone.0
