Stolen Vodaphone I-Phone 4

Well if apple are saying that the replacement phone is indeed yours now, then the second replacement with the police their should be sure proof that they are handling stolen property knowingly.
weather or not the DPA excuse they have of not pointing out who the seller is, they have to admit that either the first phone is yours and therefore you have a claim of them still in possession of your stolen goods. Or the replacement phone is yours, and therefore you have them on handling stolen items.
Try and get as much as you can in writing, when i saw what you wrote regarding 'apple admitting they made a mistake by swapping the device' i hoped you got something of that in writing or recorded the telephone call. TBH i dont see the point of blocking the buyers phone unless you can somehow get your phone back from it. You need to concentrate as best you can on hounding apple into getting you a replacement phone.
After all even if apple say they dismantled the phone, they most likely used it for spare parts on other phones. Isnt that like a car chop shop which is highly illegal. Im sure these mechanics cant use the excuse of "didnt know it was stolen until i dismantled the car" crap that apple are trying to use.
From now on record as much information as possible, dates and times you've spoke to apple employees also their names and extension numbers because if this does go to court all that information will be helpful to you in terms of your persistence to resolve the matter.
To me, this confirms apples true colours 'my way or the highway' feels like they want to control everything (by keeping you in the dark and working around you with the police) and their inability to admit fault.
Good Luck, hope it works out for you.
Ps. I'm going to wonder about the Vodafone resolution for the rest of my life aren't I? :P0 -
just for the people who think this isnt really happened, read and weep................

whats a PIR
PIR stands for personal information request. By UK law, amy company who holds information on your are required to give it if you ask for a subject acces s request. They may charge £10 but you'll have some valuable information.Have I helped? Feel free to click the 'Thanks' button. I like to feel useful (and smug).0 -
Can't help but really hope you get this sorted in your favour. I would second as much publicity as you can, Apple should be ashamed.0

Well have sent the letter to apple, for a subject access request, also for copies of all recorded telephone conversations.
Now do i ask the police for details of everything they have on the case, and also copies of any correspondence they have had with the apple loss prevention team?
And if i do ask the police for these details, who do i have to go through to get this information, is there a formal way of requesting this?
Anything else i need to do, or just wait for the information to come rolling in? and see what they say.Awaiting Inspiration......................0 -
Well Apple have confirmed they have recieved my SAR request, so 40 days to wait now.
Police have decided that they arent going to continue with case, they said they wont do anything for obstruction of justice, or handling stolen goods, even though the second time they deffo knew it was stolen.
So will await for the SAR to come back, and take it from there, hopefully Apple will see i am serious about taking this all the way, and may come to a resolution.Awaiting Inspiration......................0 -
Good stuff Smudge. Shame with the police, although I do understand the argument of priorities. Keep us informed.0

I havent lost my HTC Desire HD yet, in fact i remember that i haven't lost any phone not even my Sony Ericsson K800i. Someone had their Golf 1.9TDi 5 Door broken in to and their Samsung Galaxy S was stolen.0

Well,
Just been emailed, my SAR.
Just going through it all, and wondering if i should post the interesting bits up or not?
Or should i keep it all from prying eyes?
As i know their press office has a link to this thread, and obviously taking an interest.Awaiting Inspiration......................0 -
It does make interesting reading, cant wait to listen to the telephone conversations, but amazing how they say there are other calls, that they havent recorded, so be nice to see what is missing, particulary as the calls all went through the same number, so must have been on the system to be able to record.Awaiting Inspiration......................0
