    Quick Update:

    No call from Apple, or email despite them telling me they would be in touch within a couple of days, have just phoned, and am awaiting a call back - they have said 10-15 mins, LOL

    Nothing more from the police to report, Apple still havent been in touch with them regarding what has happened with the phone.

    So All in All not looking good

    I don't understand this at all. When I book in handsets for repair, I always need to confirm security questions to clear DPA. If the phone wasn't purchased through us, we need proof of purchase. I can't understand why Apple wouldn't be taking the necessary measures to prevent this types of issues.

    Also, Apple always replace rather than repair under warranty as far I know and wouldn't have done this if the handset was damaged. It's still all very baffling though.

    Rather than the police waiting for Apple, isn't it up to the police to go to Apple and demand the information, including the new IMEI number to trace the buyer who knowingly handled your stolen goods?

    I Agree, have requested this, but whenever i phone, i cant seem to get in touch with the officer dealing with this, and just have to give messages.

    Have the weekend off now, so time to start writing a few letters of complaint....

    Dont need to trace it, we know where it is..... its in Apple's posession, last known place was there Regent Street Store

    Am now debating on taking Apple to the small claims court.....

    What i need is all the information that Apple have regarding this repair/phone, and any computer logs they may have kept.

    I know i need to ask for this under the freedom of information/DPA is there a standard letter that i can alter for my use to request this, and would i need to request this from head office, and also from the store the repair went into?

    I still think the criminal case whereby the police pursue the buyer is stronger than your civil case against Apple. You need to point out to the police how easy this should be for them once they get the IMEI number from Apple. Don't leave it to them to work it out for themselves.

    It depends whether Apple hold any data about you, as opposed to about your phone. Speak to the Information Commissioner's Office about the DPA as they have a good advice line. Forget the Freedom of Information Act, which relates to information held by public bodies.

    After having spoke to the Police and Vodaphone, both are saying they cant trace the phone, as in find out where it is located.

    So the only thing that can really be done is to block the new sim, which as Apple told Vodaphone that is up to them.

    The reason for small claims, is because they are refusing to return my stolen handset, which by law they have to return, but they are ignoring all my reasonable attempts to contact them. have sent emails, left voice messages etc, but no reply.

    They obviously have data under my name, as the phone serial is linked to my name and address details, and my email, remember they emailed me about my repair.

    If Vodafone have details of the SIM, don't they know who it is registered to?

    Perfect. But bear in mind that Apple, if they want to be difficult, can make you pay £10 for your "subject access request" and make you wait up to 40 days for the data.
