Why not use the Small claims court, it is cheap enough, and you can include the court fees in your claim, although you'll need a day of work if it goes to your county court. You would need some legal advice (probably including the correct party to sue and the grounds), but if it gets as far as the court you represent yourself.
Even if you lose it would be highly unlikely for any costs to be awarded against you, except in the case of vexatious claims.0 -
at ironside - i've tried to check out providers of 24meg online and found that they say i can't get it, though i know others on my local exchange have it.
All this talk of 24Mb broadband is just smoke and mirrors in my opinion, I live about 500 yards away from my local exchange, which has ADSL2/ADSL+/ADSL Max or whatever you want to call it, but I have a 16Mb package from Sky but I don't anywhere near 16Mb, yes it's around 10-12Mb most of the time, but there are so many factors why I don't get the full speed (quality of line, extensions, corrosion etc), I can't imagine this changing if I sign up for a 24Mb package.
I think RT's excuse that this was the cause of the downtime is quite frankly rubbish, I work in the telecoms/IT business and this sort of change from one server to another is usually transparent to users, if there is a downtime it is only the time it takes to re-boot the server, which is usually 2mins or less.0 -

Been doing some research--the redten/watford empire is an interesting business enterprise and they are very enterprising. They do plan well and have a track record of preparation. There are a total of 11 holding companies with the mirror company image of redten --one or two of them have had some co-incidental activity from 22.2.2008 to 14.3.2008. Clodes reference to red 10 may well have been a freudian slip and perhaps they know more than they are letting on. Deja vu in watford/digital pos ltd exchanges perhaps? maybe bowing out of hardware building at least.
Certainly looks like they are in breach of the sale of goods act, consumer credit act, misrepresntation of terms,Unfair Terms in Consumer Contracts Regulations (UTCCRs)
Clode Finance would appear to be jointly responsible with redten for the service, i.e. via CCA, and computers and computer warranties, even though DS from there said it was nothing to do with them. ( they confirmed as much in 2007 when Watford went up )
Can make a complaint to OFT re above but must attempt to get resiolution first. Template letters and advice available on the Consumer direct web site and support available from which legal services --6 months membership for price of 3 £12+

First step is to complain to all 3 companies in writing and recorded delivery on lack of notice, info, service determination, whose responsible for whatis it equivalent or less than previous etc.
If anyone has anonymous open email or web site email address which people could access I'll send all the docs I've found. --eg watford took claim against another company on similar grounds as above in 2000, specially terms bit; and they were also required by OFT to give legal undertaking not to try and enforce other unfair contract terms in 2000 or 2002; I have docs.

By the way -NJP said in press report that they have no intention of automatically upgrading people from redten to 24megabits speed when their lines are enabled by BT. Mine due to be done in Sep this year. My speed has averaged 3.4 over these 3/4 days.--only hit 6mgb on 4 occasions. LOng periods of under 2mgb; mostly in off peak. Thats half of what I received previously.

I'm not trying to put anyone off in any way, just want to warn people of the problems they could face. In a few months time you could decide that you've used up all your time and your family must come first. Worth thinking about that now to see if you think that might happen.
I think our only end result can be forcing Redten to provide unlimited as promised until they go bust. I personally don't think we'd get out of the contract with them still trading, even if we're right it's another thing actually ending up in court and winning against a company.
The main way as far as I see it is through programs like Watchdog and Dom Littlewoods program etc. Basically force them into providing what they offered or go bust.0 -
At the end of the day, I was happy with the Redten product before all this b*)$%@?ks. If we had been switched to another 'unlimited' provider, then, even though the last 2 weeks have been a pain (and I've been lucky!), I'd have moaned but let the matter drop. We need to to get Redten to explain why we now have a restricted service (e.g. now economically unviable for them) and get them either to get us unlimited or cut us free without any further financial liabilities.
My thought is that the reason they've ended up with NJP is that they were the only wholesale supplier prepared to work with them, given their credit record. NJP have taken advantage of their weak position by giving them an inferior product at inflated prices. A bit like using a loan shark, 'cos you have no other alternative.Beware the character seeking personal gain masquerading as a moral crusader.

i have asked them to send my MAC code i believe they have 5 days to send it but i doubt they will so i will end up having to chase them through ofcom.0 -

Is there anyone else out there that is still not connected and cannot get in touch with Redten to resolve. I have already spent £'ss ringing and not once got through.
I have really got no option but to sign up to another provider. Surely that must be enough reason to be able to refuse payment for a service that isn't being provided.0
