sorry, another question for you all...
does anyone know to get out of the contract legitimatly?? do you just pay the outstanding balance to Clode or does it have to be done through Redten?

    thanks?
  • Nice e-mail but seeing as they're not open today (as I already posted) I don't think your problem's going to be fixed today!

not sure if this has been posted on a previous page. I have highlighted some key points, this is the Fair Usage Policy taken from Redten's website.;-

Our Fair-Usage policy is designed to ensure your service remains fast and reliable at all times. A very small number of customers use high bandwidth applications, such as file-sharing software (also known as “peer to peer” or P2P) or other applications, which constantly send and receive many different types of files, usually quite large in size. This type of activity uses a lot of bandwidth and can significantly reduce the speed at which other customers can access the internet during peak hours. Approximately 1% of customers use more than 30% of the available bandwidth during peak hours. We don't believe this is fair to the vast majority of our customers. Please be aware we may give priority to light users over heavy users at peak times. Our Fair-Usage policy automatically identifies the very small number of extremely heavy users and manages their bandwidth only during peak hours 6pm to 11pm, to protect the service for all our other customers. Outside peak hours, the use of the internet by these heavy users is not affected. We think this is a fair approach. It protects the quality of service for the majority of our customers when they most use the service, while at the same time allowing the extremely heavy users to continue to send and receive without restriction outside of peak hours. If you don't use Peer-to-Peer or file-sharing software it is unlikely you will ever be affected by this Fair-Usage Policy. If you do use Peer-to-Peer or file-sharing software, all we ask is that you use this software considerately and send and receive large files outside of peak hours. If you are affected, we will contact you by email to let you know that your usage at peak hours is excessive and is affecting other customers. During peak hours, customers affected by the Fair-Usage policy will share bandwidth with each other and will be separated from other customers. The speed affected customers experience when downloading at peak hours will therefore depend on what these customers are doing. If they are all web-browsing and reading emails, they will experience normal broadband speed. If, on the other hand, they are using Peer-to-Peer or file-sharing software they will experience slow broadband speed. Outside of peak hours, no restrictions apply. To manage your usage, just ensure that any file-sharing or sending and receiving of large files is done outside of peak hours.

I think redten in a loophole, if they allow unlimited downloads to all customers njp will bill them do death and on another hand angry customers that will sue them to death.

    quite tricky situation appears

Hi all ive been readin this thread im like you all i was conned too (i signed up 06 to) i never recieved jack diddly from any one about nothing until bt thing on screen then flurry of calls to my expense im on benefits right now and cant afford there crap they dishing out now ive been connected like most of you to njp services and have the cap and moaned and everything else sent emails ect.. the list is endless now i have an idea i know just one person doing this but what if we all do one thing together i allready the other day sent redten an email about the capped service and such and have not recieved a reply to that even though i flagged it as high priority and also always request read reciept :) now my idea is if all of us send an email asking what they intend to do and how and when !!! and if they dont reply `which they dont do to most people` via email in a set limit i say 24 hours after the mail has been read which we will or should recieve by read reciept :) then in that they are releasing us from the contract held by them and clode finance on our selves and all such moneys will be recoverd soley from them and not the user and any equipment are then the property of ourselves and not responsible in any way for debt or lose of equipment to them under them not replying to and adhearing to our request of information and a resolution!!!
now if anyone thinks this is good idea and could even stand legally if enough of us do this and they fail to reply and also if they know how to sufficiantly word this to an effect to our bennefit..

If you signed up to the finance deal through Clode/V12 Finance then you have entered into a straightforward 3 year interest free loan. You can terminate this contract at any time by repaying the outstanding balance of the loan. Although paying this off will satisfy Clode/V12, it does of course leave you out of pocket if you decide to leave Redten, because that is who Clode/V12 paid it over to.

That's the straightforward bit. Even if you pay off Clode/V12, you still have a contract with Redten for a further x months of broadband service which you have already paid for. You also have a PC which, according to my contract, remains their property until the end of the contract period. It will be very difficult to terminate this contract early and get a refund on the remainder of the fees, and keep the PC. You would probably need to take Redten to court and successfully prove that they have either misled you when selling the contract, seriously breached the terms and conditions of the contract or demonstrably failed to provide the service described in the contract. This is what we are all looking at to see if there is any possibility of collectively forcing them to deliver the type of service we all thought we had signed up for.

Making Redten deliver is probably our best option and only when we have told them what the problem is and given them enough time to fix it can we pursue a legal action. They aren't helping themselves in this matter at the moment by being so difficult to contact and failing to tell us what is going on, ans this will go against them if this does eventually go to arbitration or to court.

In addition to the finance contract with Clode, there is also the contract with Redten. Since none of us

ok nobody wants to at least try and make some sense of what i tried to say earlier in my last post even if my idea holds no legal clout it will however in some way provide a way to make redten reply on what is happening and what will happen the threat of them making themselves responsible through ever not putting right the issues and paying or making sufficiant compansation which we are all entitiled too by the way and we dont have to wait till the end of our contract we can demand that now!!! and also if they choose not to respond then well it`s a good case for the lack of customer service let alone our rights on customer satisfaction issues i still think if anyone can make some such email we could all send with the exception of our own names added :) it would at least make a quick forced show of hands quicker and better results than what every one else has got so far and as i say if no reply or joy then we have more to fight our cause is it not?

ps. sorry for any bad spelling grammer or punctuation im partly dislexic and doing these post are not easy for myself.
