    Your Broadband Fair Usage
    fu_red.gif At present you have used 27.57GB of bandwidth this month.

    A small number (under 1%) of our customers use our service unfairly; taking up a disproportionate amount of bandwidth. By constantly downloading extremely large movie and data files, 24 hours per day, every day, they affect other people's service. If your usage exceeds what is fair for your product we will temporarily reduce your connection speed to ensure you don't affect other peoples service. This speed will restrict your ability to download large files as quickly as normal, but should not affect web browsing or email.

    The status of your personal fair usage is displayed by the traffic light graphic above.

    You will need to contact customer services to discuss changing your status back to green.

    Green = Fair usage, thank you
    Amber = Caution, please reduce your downloads
    Red = Your speed is restricted



    This is what I recieved on saturday, enforcing a fair use policy before it is even published, definitely not as per my original contract.

    The clock is indeed ticking, hopefully signalling the end of such appalling abuse of customers


    I have just got this email from Fatcat::mad:

    Dear Customer,

    It has come to our attention that there has been an excessive bandwidth usage on your account. This is due to peer to peer downloading, networking and downloading excessively. Regrettably in light of this problem and in order to be fair to all our customers, we have had to slightly limit your bandwidth usage in line with our Fair Usage Policy.
    Normal service will resume at the beginning of next month as long as you adhere to our Fair Usage Policy.

    members console only shows connection log with 4.5gb usage over 3 days.

    I have only been using BBC iplayer!(think the beeb might be interested eh?:eek:

    I've got my MAC code and hopefully will be with O2 on Wednesday.
    I've not been able to view my total usage, only the connection log which tells me what time and stuff, but the other links in the forum says "Pages not listed on the menu are not relevant to your package. Please use the menu to see available options."

    Can you tell me did clode give intention to defend you claim in court. clode have told the court they intended to defend the claim in court. Should I be worried?


    yes they said they would defend it robustly--but they sent an offer to me about 10 days before the final date of them submitting an actual defense.
    I was unconcerned as I had belief n my case and had all the original papers relating to or showing the breach.

    I told them that any acceptance would be on the basis of everything finalised and settled, cheques cleared etc before that date and therefore before I was to respond to the court 2 days before the hearing date.

    They concluded everything within 2 days. My previous post outlines the nature of the settlement.

    If they go to court; you must go to otherwise if you withhdraw or ask for a dismissal, Clode may seek a judgement against you for expenses etc.

    Just checked my emails and I have my second email about bandwidth use. Just the same as the first. This will look good in court as I've not used that much since changing to Fatcat.

    DONT FORGET TO WRITE BACK TO THEM CHALLENGING THEIR RIGHT TO LIMIT YOUR SUPPLY --ACCORDING TO YOUR ORIGINAL T AND C's.
    Do not allow them to say at some point that you did not challenge the position----
    necessary if you need to go to court at some point.

    I spoke to Fatcat customer services today about the T&Cs and was told that they have not been finalised yet!. Also enquired about the upgrade to the 24mb service after reading this article http://www.pcpro.co.uk/news/178293 where a NJP spokes person said "Customers will not be moved to our LLU 24Mb/sec service automatically but will be given the option in the future to upgrade to such a service," Fatcat me that i need to talk to NJP.

    Hark can i hear the call of a court baliff!;)

    Redten's t and c's fair usage policy would only effect service during peak period of 6 to 11pm not other times. fat cat in breach of those terms by their email.

    Just sent my second email to Fatcat's accounts team telling them that their FUP policy does not apply to me as it is not the same as my current t&c s. Don't think it will do much though.
  • Pleased to say finally got my mac and free of redten forever.
    I was one of those who did not get reconnected in March and they have now let me go without penalty. Off now to find a decent ISP.
    Many thanks to all those who have contributed for such along period of time and kept everyone else going. Good luck to those who are still fighting for justice. Just keep at it!!

    I've been keeping an eye on these pages and am just so relieved that I stopped paying my direct debits when our Redten service was originally suspended and have stuck it out refusing to pay anymore to Clode - that said I've been lucky enough to be with sky so have at least had a decent service (even if the router they sent initially blew up!).
    I've finally - after loads of letter/calls and mails, been sent a letter from Clode advising me that I have no further laibility for payments on the account and any goods are to be retained. Mind you they still maintain the pretence that Redten have given them instruction to close the account. What finally did it? Threatening to take them to court if I didn't hear within a week. Not sure if that will work for everyone, but it has for me and I am so relieved to be out of this. Lesson learned - if it looks too good to be true, it is.
    All the very best of luck to everyone else on here - and thank you so much because it really has helped knowing other people were going through this and also learning a huge amount from a lot of knowledgeable and very helpful people on what action to take.
