I also received a letter from Louise on Friday that they have received instruction from Redten to cancel the contract, which is funny seeing as I haven't been with them for 4 months and served my court papers last weekend?
Am I to cancel the court papers and just accept it? They've taken 3 direct debits since the broadband was cut off in March and I would like that back! Should I just write back to them and demand it or leave the courts to decide? I just want that money back for a period I didn't have their broadband and I'll be happy to finally be rid of all this mess.
It depends on what you are claiming at court, does your claim include the 3 months payments? If so then I would personally leave the court papers running, and contact Clode for the return of the money you paid for the service you were denied.
Only cancel the court papers when you feel that Clode have been reasonable with your settlement.
I am assuming you are with another isp now, so stick with it, my case was a little different, as I had no broadband and a tag on the line preventing me from moving to another supplier.

I have only just filed my papers so it will probably end out of court, but if it doesn't I will produce my ASA letter as part of my evidence. The status on Money Claim is showing "Issued", how do I tell when clode have received their copy?
I think that you have to allow 14 days from when they are considered "served" which i THINK is 5 days after the date of issue. It tells you somewhere on the site, sorry I cant remember where exactly.0 -

You may not be aware but NJP Services Ltd was contracted by Redten Communications Ltd (Redten) to provide a wholesale service on their behalf for your broadband connection. If you would like to continue using your broadband service beyond this date you will need to contact us directly so that we might continue your service through one of our other brands. If you choose to continue your service with us then you will be able to retain your current connection utilising the same username and other details as you do currently. In short, your service will continue without interruption.
If you wish to continue your service with us then please telephone us on
0871 424 0185 before 30th June 2008 in order that we can transfer your service to an alternative brand. You will be required to enter into a new contract for this service and make a monthly payment for the service provided. The new contract is only one month and you will therefore be free to leave the service at any time by requesting a MAC code (or a
cease) from your new provider. If we do not hear from you before this time then a cease will automatically be placed on your broadband connection on 1st July 2008. This will normally complete in around 7 days, after which time you will be able to join any broadband provider that you wish to.
Please be aware that although we have been providing the service to Redten we are not responsible for the actions of, or the (unknown) financial situation of, Redten. We are therefore not able to honour any agreement that you may have made directly with Redten. If you have prepaid for your service with Redten then you will need to contact Redten directly to recover any money that you may be owed.

Makes me laugh though - talk about contradiction in terms...

LOL go on then. How? If the person who is PROVIDING THE SERVICE cant contact them, how on Earth could the customers. Its a mess/joke that these people who have paid for 3 years service up front are now going to lose out.
If Redten goes into liquidation (probably already have) then they will simply be numbers on the creditors list and stand no chance of getting money back from Redten.
Your only real shot at getting money back is if you paid by Credit Card - they companies should back you up. If you paid by Cheque/Debit card then I think, basically, you are screwed.0 -

After 2 months of waiting, I finally got my MAC code (via Clode) on Friday (even though Clode has originally told me that as my DD payments had not started, they would have nothing at all to do with obtaining a code for me).
I sent an e-mail to Clode (various e-mail addresses picked up from Deadten.com, thanks), NJP, Murphx, Redten (again, all the addresses I could locate) last Thursday to state that if I didn't receive my MAC code within 24 hours, I would continue to bombard all parties with my request on a daily basis (at least). Within a few hours, someone from Clode phoned to say that they had requested a MAC code and I should have it shortly - the next morning to be precise, and direct from Redten Care Department! Don't know if it had anything to do with my threat to keep sending my e-mails or if it is instead due to the situation advised in the NJP letter received by Nel.
Anyhow, I'm free! Well, as long as my MAC code works...
Thanks for all the advice on this forum; good luck to all those still to be freed.
P.S. I did find it interesting that I received a read receipt from 'cs@fatcatinternet.com' stating my e-mail had been deleted without being read - must have been redirected from one of the various e-mail addresses I used...0 -

Looks like Clode saw this coming and everyone will now be slammed again across to fatcat internet, I would suggest anyone with a clode contract to write to them demanding clarification of their position, once again holding redten in breach of contract and holding clode jointly responsible for that breach, if you have already done the paperwork from the April breach, get your court papers filed.
I suspect that those who did nothing in April may have more of a problem as the T&C changed and may give additional get out of jail free clauses to both RT and clode.

I got a whole bucketful of messages deleted without being read, as I was sending them daily to RT asking for a mac code

It appears a bunch of release letters went out from Clode late last week. This coincides with NJP getting stung by RT and deciding to cut loose.
I suspect Clode are preparing a "Final Solution" to the Red Ten Problem. 1st dump the cases they can't defend, the ones that won't pay settlement and will cost them in court. I imagine that'll still leave a number of less militant customers who have very low use profiles or are otherwise vulnerable. Prepare a service that however useless, is still legally a service of sorts. Slam the remainders onto the useless service while the direct debits come in. The only thing they have to worry about then is passive customers cottoning on or wanting to use the net more and going legal on them. I bet there's enough passive accounts out there they can pump direct debits from to make the whole debacle break even, if not even make a bit of an earner from.0 -
