    Its been an eternity since I posted first posted the wholesale notice but still stuck with redten. Anyone have any advice for ppl paid up 3yrs in advance. Basically dont want to pay for 2 bband connections. I havent found any capping of my account other than the notice on the My account section. Have exceeded over the last 2 months. Keep up the good work all!
    I'm in same position as you. There is a useful intro about claims against card companies here http://www.bbc.co.uk/consumer/guides_to/credit_liability.shtml
    I'm in two minds about claiming as, like you, I've gone over the cap without penalty. Once I have proof of an active cap, I'll claim. The card company will want you to show that you have unsuccessfully tried to reach a resolution with RT directly. (Not difficult with a company that fails to respond to customer / trading standards communications.) I've drafted a letter that I'll PM you.

    If you want to go over your cap download Linux distros (via bitrorrent if possible) this will really get your usage up. I past my limit at the weekend and I am now on just worse than dial-up speeds.:confused:

    Sorry to hear that but my point was that, having exceeded my cap last month, I was not penalised. I need to download a Linux distro soon anyway so may well do what you suggest (nearer the end of the month!) The worst of it is the uncertainty.

    I signed up in Dec 06, getting a free computer and paying £20 per month. I have just sent a 'notice of imminent action' letter giving Clode 7 days to pay back the payments I have made since the contract breach, to cancel the remaining payments and to provide my MAC code. Luckily I sent a 'notice before action' letter back in April to Clode and Redten, advising that if they didn't restore the original contract terms I would be taking them to court. I would advise everyone to do the same, if you want to guarantee an unbroken internet service (i.e. if they go bust or get cut off for not paying bills you won't get back on broadband for several weeks).
    I've used the small claims court twice in the past and both times have received an out of court settlement: once where I bought a computer system from Time Computers that they had (unbeknownst to me) mistakenly advertised on line as including a flat screen monitor, which they then refused to supply - I bought an equivalent monitor from Amazon and took them to court to claim back the cost of it (they settled out of court and subsequently went bust); and secondly to reclaim bank charges. It's a fairly straightforward process using moneyclaim. It's just important to follow the legal process - the judge would really like this kind of case settled out of court, as it's blatantly a breach of contract by Clode. He therefore would expect you to give them every chance to remedy the breach before you lodge your claim. This basically means sending a 'notice before action' explaining exactly what the breach of contract is, that you expect it to be rectified within 30 days and that otherwise you will be seeking redress in the small claims court. If 30 days pass and you have no joy, you must then advise them further that you will be lodging a claim in 7 days of receipt of this letter, unless they send you a cheque, MAC code and terminate the finance agreement with no penalty to yourself.

Still not long for me before I escape and I do have a dial up number set up on my laptop, so NJP / Redten can go take a running jump, as I am almost gone, and their petty speed restriction isn't a major problem. My main hope is that OFCOM eventually come down hard on them for their numerous breaches.

Also difficult to claim ongoing interruption and lack of service from Credit Card. Have to ride it out until next breach or redten out of it so can get MAC. Meanwhile cap isn't applied and speed retained. Grateful for small mercies, but I'll still be out asap from these twisting b*****ds!

  • So have any prepaid users been capped yet? I think if there are then I guess we're just riding our luck and am all for getting out. Anyone able to confirm capped accounts of advance payment?.
