New ISP set up by clode. They will tell everyone we have unlimited access subject to fair useage. Anyone goes of 15gb they tell us against fair useage and throttle us. This explains the new company AND the fact we cant access our bandwidth monitor anymore....

Thats where they have everyone over a barrel as the speed issue is something they can get away with as it states up to speeds, I think they will try and sicken everyone with rubbish speeds as punishment for complaining. I wonder what speeds those who have not complained and happy to accept all this crap are getting?
As a thought are the offers still open to accept in the light of things it may be better to cut and run to save sanity, it cost me £402 but it is the best feeling in the world to know this is nearly all behind me.
As we speak I am uploading and downloading night and day (legit stuff of course) to wring every last penny out of them before wednesday

There was a clause in the T & C which off the top of my head stated that they had a right to transfer us to a different provider of 'equivalent or better' quality. If the speed doesn't pick up or there is an unreasonable cap on the service, we can have them up for that.
As far as I'm concerned, I'm waitiing to see what Clode come up with before taking legal action. Once they've shot their bolt, it will be easier to make a claim. Reduced speed is very easy to provide evidence for, as is capping / FUP.Beware the character seeking personal gain masquerading as a moral crusader.

Does anyone know where this latest turn of events leaves me? My service never got transferred over to NJP. My line had no tag on it and the Mac from the walled garden allowed me to move toTiscali who I've been with since April. My direct debit to Clode continues to be lifted out of my account every month for a service I no longer receive and the best Clode could do was to offer to release me from my contract in return for about £300 for my "free equipment". I was about to file a small claims action in the Scottish Courts but I'm confused about who I'm claiming against now that Nick Davies is claiming that Clode Retail Finance ltd aren't liable and another arm of the Clode empire is.
Any help would be appreciated.0 -

Ned, I'm going the same route as you here.
I've been away for a number of weeks and haven't been able to progress any sort of claim etc against these scum sucking lowlifes aka Redten/Clode/NJP/MurphX
Like everyone else the limits appear to have been lifted via NJP panel, else they just won't allow us to know what we've used until we breached some new FUP they have dreamed up that yet again they have decided not to advise their customers about via letter or any other means.
I had already rejected their blanket stonewall letter that didn't even start to address the issues I'd complained about by RD before, I think it was the 14 April deadline?
My speeds have fluctuated so much with NJP and I still can't use my connection the way I used to when we were with Redten/BT
I so faxing well faxed off with this bunch faxing can'ts (said in an east London accent!) that words fail me completely, I also getting so wound up that whenever I attempt to use my connection to do something productive, NJP sever my line with a stop/start and I must recycle my router before THEY will allow a re-connect. It absolutely stinks.
I dunno about their new ISP name Fatcat Communication, I think a more fitting name should have been.... :mad: FatFaxingCantsLaffingAtTheirCustomers :mad: .......Does it show that I'm not a happy customer?
Sorry to everyone if my choice of language offends, I'm just so fed with this never ending crap were enduring when no one (Authorities) will actually do anything to help us.

so does anyone know if anyone has gone over 15gb this month? I know that I must be close (probably at about 12gb) I could easily go over the 15gb but reluctant to as I have some important work to do this week and can't afford the reduced service.0

I had used over 16Gb so far this month, then the bandwidth monitor disappeared, so far no reduced service.0
