Got my letter from the court yesteday - papers considered served 18/5 Clode and Redten have until 1/6 to respond.

Ill be glad when its all sorted. It still makes me angry to think about how these people get away with flaunting statute after statute and there seems to be no government body prepared to actually do anything about it.

Question for essex or whoever else has issued court proceedings, mine was "issued" yesterday and defendant has 14 days to reply.

    2 Questions.
    1) If they were issued yesterday, when will they actually be served?
    2) Is it 14 days, or 14 WORKING days?

Actually, Ill have a quick look on the site now and see if I can tell...

Edit: No, help screens arent really... erm.. helpful!

Being served is taken as 5 days from issue, From what I can tell this is actual days not working days same as the 14 days to respond.

Just checked online and Clode have Acknowledged my court papers on 14/05/2008, they have 28 days from the date they were served to file a defence which I make to be 3rd June.

Just checked online and Clode have acknowledged my papers on the same day essex. My deadline is however a little further forward than yours, its 15th June.

Rather surprisingly Redten havent acknowledged - dont expect them to either. I think they will be getting several more "CCJ" events in the near future.

One of those upcoming CCJ events will be mine! I made my claim against Redten (for return of £49.99 deposit) on 25.4.08, and following their failure to respond in the 14 days (surely not I hear you gasp!) I have today issued a Judgement by Default for the deposit plus Court costs. Don't know how far I'll get, but I'll be damned if I'll just roll over and let these charlatans get away without a fight. They are without morals or scruples, and have used us, their customers as cash cows and nothing more. They seem to set up and fold companies as quickly and easily as I nip to Tescos for a pint of milk. It's about time someone called them to account.

Apropos of which, in a very interesting last-minute development, I have just been contacted by a nice young man from Tower Hamlets Trading Standards. They have been tasked by OFCOM to collate information on Redten as their registered office is in their area. I asked him if he was aware of this forum, which he was. I imagine a number of you who have complained to Trading Standards in your own area, or through consumerdirect, may be getting a call. Is something going to happen at long last???? I certainly hope so.

Keep the faith one and all!

    Something interesting happening here.
A number of people have stopped their DD's and heard nothing from Clode. I stopped mine and like some others got a reminder letter to pay.
When I called them about it, I was told that it was an automated letter and was sent to anyone that missed a payment. If this is true then why are some people not getting them.

Just trying to work out what the pattern is for this, not sure if it's due to when we signed up or not. I signed Nov 2006 and got the reminder letter, anyone else have any ideas.

    http://www.deadten.com

That was the case with me,Cancelled the DD, nothing doing. However I got a letter the other day. On phoning them, I basically gave them an earful of unhappy customer. To which they said write them a letter. To which I said I didn't want to waste any more tree, but eventually they were happy to get my complaint by email.

I've now got a stock holding letter acknowledging my complaint. I'm of the opinion they can spend money and take me to court if they like. From my point of view, I like my odds of a favorable outcome.
