I sent a written complaint to NJP on the 23.3.2008 and again on the 31.3.2008 regarding their failure to comply with the OFCOM regulations.
As the Cancel order is usually applied during the transfer, it may be that NJP only way of complying now would be to issue you with a mac code.
However if they now complied with the cancel order, your service would be ceased until you signed up with another supplier but at least you would be free of them.
Maybe it was because I had complained about NJP and their failures that OFCOM were going to assist me to have BT breach my line ie to cancel the service being supplied by NJP and using the regs of General condition 1.2.
Certainly it was after that threat that I got my code from them.
The regs are set out below. ( you need to read them a few times to understand them )
To ensure compliance with General Condition 1.2 Ofcom expects all Communications Providers to apply Cancel Other only in the following circumstances:- Where a request for a fixed-line telecommunications service has been made without the customer’s express knowledge and consent (“Slamming”) or at the customer’s request, that is, in the following circumstances:
- where the customer confirms that they were never contacted by the gaining provider (Cancel Other code 9X50);
- where the customer confirms that there has been contact with the gaining provider, but they had not given the gaining provider authorisation to transfer some or all of its telephone calls and/or line rental to the gaining provider (Cancel Other code 9X20);
- where the customer confirms that they agreed to purchase a product or service from the gaining provider and the gaining provider has submitted a request for a different product or service which the customer has not agreed to purchase (Cancel Other code 9X70); or
- where the customer confirms that they agreed to transfer some or all of its telephone calls and/or line rental to the gaining provider having understood, as a result of a deliberate attempt by the gaining provider to mislead, that it is making an agreement with a different communications provider (Cancel Other code 9X60);
- at the customers request where the customer confirms that the gaining provider has failed to cancel the request after being directed by the customer to do so (“Failure to Cancel”) (Cancel Other code 9X80);
- where the telephone line is ceased during the transfer period (“Line Cease”) (Cancel Other code 9X40); and
- for other specified reasons not related to a customer’s request to cancel a transfer, and agreed by the service providers forum (Cancel Other code 9X00).

Im still really hardly using the internet at home as I dont want to be throttled like that!!!

I'm beginning to think our approach isn't right. We've made it perfectly clear that we're willing to contest civil cases, and bring in regulators, which doesn't seem to have worried RedTen/NJP/Clode at all.
Which set me to thinking, how do we up the ante to apply some pressure on RedTen/NJP/Clode?
My answer? The Fraud Act 2006.
In the past, the police were very tentative to prosecute white collar crime, because there were so many differing types of fraud, all covered by differing acts of parliament, that cases often collapsed because the cops and even the CPS chose the wrong type of prosecution and the fraudster got off on technicality.
But all those bills were consolidated into one act in 2006, making it much easier for Police to bring a criminal conviction.
I strongly suspect that suppling a limited service when you're paying for the promise of unlimited, could be construed as fraud. I think the ambiguity of whether it's the PC or the service which is free could also form part of the case. Come to think of it, promising free software an not supplying it could go in as well.
In short, I think we should be considering criminal proceedings. Time to phone the police?0 -

I take your point gnip, you're right. The fuzz aren't going to be interested in an isolated case, but where it's a lot of frauds, where you multiply lots of £19.99 x 3 years x lots of users, giving "Tech savvy cops sucessfully prosecute Hi tech ISP fraud, lots of dosh involved". They might get a bit more excited about that.0 -

Okay i have just spoken to the police. very helpful at this moment in time this is a civil issue because of the finance agreement. When this gets to court and the judge or your legal advice team think that there is something to answer on fraud then they will get involed and prosecute. I have made them aware of this situation but until the first case hits the courts it is still wait and see.Ron.

Going on recent performance of the various regulators mentioned I would think that subject to Redten going under completely this situation will still be with us in 12 months time. don't really mind any more as direct debit payments to Clode are cancelled I'm on free albeit crap service, my legal insurance are paying me the amount I was claiming from Clode as their costs would be far more than the sum involved.
As for MAC I guess we will find all service ceased one day and have to start all over again.
Oh and in this age when multi million pound card fraud is of no interest to the police, you can not even report it to them only to your bank I doubt they would show any interest in the fraud aspect.Who cares ??0
