    I got the standard "You've missed a payment - perhaps this was an oversight?" letter yesterday.

    I had already notified them that I was stopping the DD several weeks back - I don't know whether they bother reading these things or not? No moolah for them in any case :rotfl:

    Agree 100% about the very poor service from NJP regular drop outs adsl sync ok but pp failure rare event with Redten/BT but every couple of days now, yesterday was for a couple of hours maybe they want us to go away I wish :confused:

    Finally got a reply from the Financial Ombudsmen - Toothless Beaurocrats or what?

    I sent this on 13/04/08:

    Dear Sir/Madam,
    I wish to make a complaint about the above named company. In November, I signed up for 3 years unlimited broadband service which included a free PC and upgrade to 24Mbps with Redten Internet. The agreement involved taking a 3 year fixed term credit agreement making monthly payments of £19.99 to Clode Retail Finance, who advanced the finance to Redten. Both broadband service and PC were received in January 2007 and were perfectly satisfactory until 10th March 2008.

    On this day, our broadband service was pulled by BT without any warning from any parties involved. After 10 days, I was reconnected to broadband using a different provider - NJP services. This new service initially had a 2 gigabyte per month usage cap, which rose to 5 gigabyte and now a 15 gigabyte limit. At no point was I given any correspondance informing me of a change in the service provided and a way of opting out.

    I have complained in writing, sent recorded delivery to both Redten & Clode Retail Finance, who I gather are jointly liable to request that if my originally agreed unlimited broadband service wasn't restored forthwith, that they release me from my financial obligations without penalty or any adverse effect of my credit rating as I was no longer receiving the product/service originally ordered and the original contract had been breached on several counts. A month on, it is apparent that my originally ordered service will not be restored.

    After the specified 10 days, I have received no reply addressing my complaints from either company and am now left in a position where I am receiving a wholly unsatisfactory product, for which I am locked into paying a premium amount for. I am unable to stop payments for fear of court/debt collection actions and a black mark on my rating.

    I appreciate the broadband side is for Offcom to deal with. But, even if I was allowed to migrate my service elsewhere, I would be stuck paying Clode for the remainder of the term, which I feel is unfair as i haven't deviated from the agreed terms. I would be grateful if you could investigate and force Clode to cancel my agreement if you felt it was appropriate. I can supply numerous documentation including original contract, t & c and correspondance if this would be helpful.

    And I got this today:
    I refer to your recent email.
    Unfortunately, the Financial Ombudsman Service is unable to assist with your complaint as it relates to an unregulated product. Your complaint relates to broadband and the finance company. This activity is not covered by the Financial Services Authority and as such we are unable to assist.
    I can only suggest you contact the Office of Fair trade or Ofcom, who may be able to assist.
    Should you require further assistance, please contact us.

    Is it me or does everything/everybody suck. Ombudsmen suck, Offcom suck, Redten SSSSSSUUUUUCCCCKKK, Clode suck and NJP sucks. Doesn't leave many others does it?

    Start a business, get lots of customers to pay upfront then do a runner with your ill gotten gains and you will think all those gov thingys like Ombudsmen Ofcom and F-offcom are bloody great and very kind to you they will give you more than enough time to get away with robbery

    think redten have got away with robbery clode are left to sort out the mess and pay njp for the broadband they are loosing money the way i see it they are paying for the broadband that redten are supposed to be paying for instead of paying of the balance of the loans with the direct debits i think we could see a case of clode vs redten in court

    The proposals were set out today ( 8.5.2008 ) in a major speech on consumer protection by UK Business Secretary John Hutton.

    John Hutton now wants business and consumer groups to come forward with evidence that could inform the root and branch review of consumer law.

    Bringing together a small number of core consumer rights into a single Act of Parliament
    * How to encourage swift and effective dispute resolution between business and consumers?
    * Whether changes might be required to keep pace with technological developments like the internet?
    * What changes would most help enforcement bodies target their resources on rogue traders or those that deliberately flout the law, and ensure that honest businesses do not carry unnecessary costs

    John Hutton added:
    "This survey, the first of its kind in the UK, will shine a light on unfair or anti-competitive behaviour and root out problem sectors or industries.

    the Department for Business, Enterprise and Regulatory Reform has also commissioned IPSOS MORI to produce a unique Consumer Survey.

    The right to 'get what you pay for' is expected to cover purchases either in terms of quantity or fitness for purpose, or the service being completed with 'reasonable care and skill and within a reasonable time'

    I suggest we all email John Hutton with our evidence of the operation of the current consumer protection laws and enforcers for his information to ensure that any changes he envisages actually deal with the reality of the lack of consumer protection and the ineffectiveness of the current organisations.

    Maybe if he hears it directly from us others in the future may not have to go through what we have gone through.

    Clode are almost certainly indemnified by redten and their insurance against any losses by customers not paying them for failures by redten to provide the service.
