I just emailed clode asking again to cancel contract.
I have now got Orange unlimited package with free calls etc and a mobile that works on wifi as well as a second voip line with free calls.
Luckily I had a second line without broadband on it.
I told them no mac required just cancel.
They are **** heads one and all and I don't expect a response.(I didn't tell them they are **** heads by the way)
If the fabled letter dosn't arrive next week then it's small claims court for me.

Called clode's MD Nick left 4 messages and sent two texts. Not one reply. I don't get rude on the phone but they know I'm frustrated that they have failed to follow thier own complaints procedure and I told them my only option now is the small claims track of the county court.
I Guess we are being stonewalled now. I for one will not give up. When you speak to the call centre you only get gimps who dont want to tell you anything. I did ask yesterday about the letter being sent out and what the letter contains, my answer was "I don't know".
I for one will file my court papers on monday and trading standards have said they will help me every step of the way.
As consumers we have rights and I will use these rights.0 -

Thanks for your hard work essex......what makes me sceptical is the fact why sunday?? when I find it hard to speak to anybody dealing with the matter in person because they have gone home through the week. So who is going to be working sunday, and if the email is already drafted why not send it at close of business today, then we may all.....maybe enjoy our weekend
Who is supposed to be organising it at redten if the sole director has resigned?

What I actually said was that due to a number of Breaches of Contract I wanted my contract terminated with no financial penalty, copied to both Clode and Redten.
I don't call buying out my contract no financial penalty.
Just reminded Mr Davies of this email, as he was copied on it,
give him his due he did reply immediately, but said his position had no changed and wait for the offer.

many thanks for the updates Essex.

Hi all
I have just spent today writing out the claim for lodging with the Sherrif Court here on Tuesday of next week.
The summary claim has 12 points and the witness pleading runs to 13 pages.
A full copy has to be sent to Trading Standards in Dunfermaline for forwarding to Wales and the OFT on Monday.
On another note, I could buy out my contract anytime I chose previously as could all customers. redten cancelled the contract when they failed to supply it, and Clode as jointly liable are now jointly liable for the alternative provision which I have secured with BT and also for the additional expenses which I have incurred and will incur in the pursuance of those renumerations.
I shall be holding the payments to Clode in lien of their debt to me for the alternative service with BT for the remainder of the contract period.
If they wish to make me an offer to buy their way out of their debt, they have already had 2 chances to do that already.
If they leave it until I have lodged the claim at the Sherrif Court then they will also be liable for my and my solictors expenses, the buy out cost to them will grow by 8% interest charge, the longer they leave it.
My solicitor charges £280 per hour and her legal assistant is £240 an hour, therefore just to lodge the submission will cost more than the current debt of Clode.
Silly people.

=======================================
I would just like to inform you that I have officially resigned as Managing Director of Redten as of the 18th of April 2008.
I would like to kindly ask of you to remove my details from your site as it is no longer relavant and that I have handed in my company phone of
07717500582. But my personal phone still remains.
People can still attempt to contact me but it will be to no avail as I will not have any answers for them as well as I am not legally obliged to comment on the
running of the business.
So please encourage your guests to refrain from sending me mail or attempting to call my personal line.
Kindest regards
Baber Gulzar

has anyone else noted the significance of 18.4.2008.
That was the new date on NJP services site as the end of their initial contract ( which had been updated from the 11.4.2008 ), it was the date given for my and harlzter ending of our contract.
I still think redten will take the short route away from their problems like before --say in a month time by 18.5.2008.
New director appointed, new address, new company name and they can pursue the cheap calls scheme that just been got up and running via saverstaore!!!!0 -
