by the way just for those that get bored waiting for the mail or waiting for that magical phone call and to all those that cant do nothing more than browse on the cap then give this a try when feeling down go pick on another town on this :)http://s4.ikariam.org/ its free and as i say it reduces the tension caused through lack of response or what ever i find it very relaxing and gives me time out of the redten / clode debate!!!

    and dont say it !!!
i know its of topic but just thought it might help ease the pain :)
  • hello everyone,

    Just a quick update:

I have no response to any letters and emails which I sent to all 3 companies from the 22.3.2008. ( This does not include the original email of the 11..3.2008 to which I received an email response, with we now know misleading information )

I know they were received and some read with a day of sending.

I have had no response, promised verbally, to my request for an up date of my account position at Clode.

I am no longer making phone calls which do not result in any positive response. All communication will now be in writing as I fully intend to take it further.

    Today Clode
    1. I shall send an SAR request with £10.00 postal oder to cover the costs of same to Clode. I expect a response within 5 working days.
    2. I shall ask formally for a settlement of cancellation of my account from the date of 10.3.2008 when my contract was broken plus any expenses I have undertaken to find out what had happened and since that time.
They shall have 14 days to produce confirmation and cheque re this.
This will be followed by a full complaint to the Financial Ombudsman for settlement on those terms.

    **********
    Today Redten,
    1. I shall lodge all my paperwork with OFCOM as requested.
    2. I shall make a further complaint to OFT.
    3. I shall send a further letter to Redten at the Company House address advising them of the need to give me a mac code and advising them that paperwork will be sent to BT who will be breaching my line. They will have 3 working days to respond.
    4. I shall email copies of these to them at their only working email.
    5. I shall lodge that paperwork with OFCOM.
    6. I shall report redten to the OFT for breach of the consumer credit legislation for releasing my financial information to a third party with my agreement or knowledge.
    Today NJP Services.
    1. I shall send duplicates of redten letters and take the same actions to NJP.
    2. I shall report both redten and NJP to the Financial Ombudsman for breach of the data protection act and breach of the consumer credit act. for disclosing my financial information to a third party and not destroying it on request.
OFCOM--I will await OFCOM coming back to me by Wednesday with or without a mac and then have BT breach my line if no MAC forthcoming.

I expect to lodge a small claims against Clode, therefore in their area and not London, by approximately 1.5.2008 if I have not received a satisfactory response from them by that time.

--thanks to all the posts today --specially about the paperwork to OFCOM.

I do feel that anybody stopping there DD would only be acting reasonably
given the current situation with what your being provided
But thats just my own slant on whats fair and what isnt fair
I feel that very soon if redten go bust that a deal between them and njp will see them becoming part of njp in sort of name only like a rebranding and then there will be no chance of claiming against them
I feel the wheels are in motion

Seeing as the redten customers on this board are so nice, why don't the Redten directors pass their shares over for us to run it as a not for profit partnership?
At least that we, we would have more control over our own destiny.

Unless you're a family member or related in some way to the Jessa family, I really don't think that's likely to happen, do you?
My bet is that Redten goes to the wall, just like all the other Jessa family businesses before it, aka Savastore, Watford Electronics etc etc
It'll be sell all the assets to yet another family member for about £1 then allow the Ltd company to be wound up.
I wouldn't be surprised to see that happen on say 14th April and then find out that a new Red...company was set-up just before say about the 12th. Only time will tell I suppose.

Just found this on webuser web site

When I was changing ISPs I looked into RedTen and phoned up their sales line about cancelling the contract part way through as it's not on the website.
Put simply, it just isn't worth cancelling the contract; the cancellation fee is the same as it would cost to keep the contract going for the full 3 years.
If you signed up for a 3 year contract at £12.99 per month, then over 3 years you would pay £467.64. After one year you would have paid £155.88. The cancellation charge would be £467.64-£155.88 so you would have to pay them £311.76!
Needless to say, I didn't pursue it further!
Unfortunately, I decided to go with Fast4 (run by NJP who appear to be taking over RedTen). I signed up for an unlimited account, but this has now been changed to having a 15gb limit - I'm not happy and as soon as I can I'll be leaving. (As yet, I've never downloaded more than 15gb in a month, but I signed up for an unlimited service I'm not getting. Last month I downloaded 14.6gb so that's close to the limit and they only sell extra bandwidth in chunks of 10gb @ £18 per chunk!)

Redten assets, shares and logo and all charges due to redten is already mortgaged in its entirety to Online Distribution Ltd. owned by Shariz Jessa.
This happened in aug/sep of last year the month after Shariz Jessa stood down as Director of redten, because he could not do it as a director or would have broken company law and been disbarred from holding any director ship.
All it takes now is another 24 hr job of lodging the papers with company House and the old redten is no more and the new is re-born--like another phoenix rising from the ashes.
    Thats why Clode are worried.--

REDTEN DO NOT HAVE ANY ASSETS--THEY ARE ALL MORTGAGED TO ONLINE DISTRIBUTION.
