What utter rubbish. The rep has stated he can't help you. If what you rant is true, why bother going into lots of details when he won't deal with it? If you DID want to communicate with HIM, send another email.

As for the rest - IF you ever do as you originally said and go to court you'll need a MUCH better presentation of any case than you've put on here.

So, one final piece of advice - DON'T go to court.

I have not presented a case here, you barely know a thing and are quick to judge. But again thanks for you opinion. Glad we cleared it up, again. And I do have a case as I have clear evidence of Vodafone charging me late payment fees even when I paid on time. I cannot email the Vodafone rep as I have no email for him.... So I will chill here until I have a definitive reply from him.

Gentlemen, you think you know more than you do.... About me, the case, Vodafone, the court system.... Well just about everything. So thanks for your opinions. They are of no help, but I thank you nonetheless, between you both you have made yourselves clear. Now you have aired them feel free to move on from me. Take it easy.

    Hi Silk,

    I've raised this with MSE.

    Hopefully it'll be fixed soon.

R91 - I've got your last email and I'll get back to you as soon as I can.

Loosetooth - I appreciate that you're unhappy with the conclusion reached by the Ombudsman.

However, as stated last week, I'm unable to help you.

keep_flyin - I'm glad to see that things are nearly resolved for you.

    Kind regards,

    Lee

Lee as stated multuple times, the Ombudsman did not reach a conclusion, the process was ended before it was concluded.

However I appreciate you are not willing to look at the case.

    Many thanks.

The problem is according to you they did ..........

The Ombudsman was pathetic... taking months to decide anything, accepting anything Vodafone sent them as legitimate evidence (I was not allowed to see what Vodafone was telling them) and ignoring my testimony as not really evidence at all. They took a long time to uphold my complaint and offer me a pathetic settlement (£40 compensation, a lesson from Vodafone in how to use a computer and a letter of apology).

I told you that I am not here to argue with you. The complaint to the Ombudsman was withdrawn as their solution was not satisfactory to me. The reason for withdrawing the complaint is that it was not then entered conclusively, which allows me to pursue other recourse.

So yourself and Lee are wrong here... for you there is only Ombudsman or No Ombudsman, there is a third category, I went to the Ombudsman and agreed with the evidence they found, but did not agree with the fact that they did not accept some evidence and their proposed solution was unfair to me.

Had I allowed the upheld complaint to stand then I would have been legally bound by it and would not, for instance, be allowed to go down the Small Claims route.

The Ombudsman proposed a solution, I rejected it and withdrew.... the solution proposed was not applied and was, therefore, not conclusive.

So... many thanks for your "help", but you are not willing to consider anything other than what you have decided. I am currently reviewing the investigation of the Ombudsman - which contains lots of sentences like "which represents a further shortfall in service" & "we conclude that Vodafone incorrectly charged you LPFs... we acknowledge shortfall in service" etc.

You want to make me a man that rants (actually I reviewed our conversation, my "rants" are replies to you and the other one and your replies are just as long as mine.... so either we were having a conversation or we were both ranting) and does not get it and blahblah. Actually I am a dude who has received pretty bad service, is affected by it and is desperate to find a reasonable solution. That is something that now has to go on out of here, but do not try to metaphorically flip me the bird and tell me that this is me and you told me so.... just allow for the fact that you do not know everything.

    Take it easy.

This is the problem though, the Ombudsman reached a decision and you rejected it. The process reached a conclusion, once that happened you cannot withdraw the complaint.
The decision cannot be appealed but can be rejected which is what you did.
If you feel you have a complaint against the Ombudsman you have to follow the complaints procedure
The only options left to you are to go through the court if you feel you have a case or give up and call it a day.

You are incorrect, but I have emailed the Ombudsman to check.

By withdrawing the complaint at the stage where a solution is proposed, but not applied, the process is not concluded. I did not reject the decision.... I withdrew the complaint so as not to be legally bound by it.

You are given 6 weeks to agree to the decision or reject it, it would only be binding if you agree to it during that period.
If you fail to accept within the 6 week period it is deemed to be rejected anyway and as explained cannot be appealed

I'd ive up, Silk. As yor friend "the other one" it is quite plain you are hitting a brick wall. As you said, there are only two options left and he doesn't seem to want to actually take either one of them.
