  • Silk, TBH at the time I really had no idea what was wrong either phone or the card. It simply did not occur to me to try the card in another phone and at the time the only PAYG phone that I could use was locked to Orange therefore I used this while waiting for 8 months for action.

    grumbler, I see what you are saying but I was actually asking for something to be done to replace the handset. These request seemed to be ignored and Vodafone now say that they have nothing on record!
    You say services can be used with any handset. Are you saying that I could use a Vodaphone monthly sim card in an Orange locked handset? If this it the case then I have learned something new.

    Not sure I can understand the point about service as I could not use the so called service due to a phone failure of some kind preventing such use. Therefore IMO the provider needs to put this right in order for me to use the service I am paying for. In the event this did not happen and my communications were ignored and it appears were not logged in anyway by V. It is not a simple case of someone providing a service which I decided not to use but a failure to allow me access to such service. How long should I have to wait for the problem to be resolved and how many letters and phone calls do you estimate it would take to get this sorted?

    The point is that I was paying for a service that for whatever reason was not available to me for a period of 8 months before I was forced to take the action I did.

    The airtime contract is separate to the contract for the handset. Your handset failing does not 'suspend ' the other contract. Providers will sometimes lend you a spare mobile, but they're not obliged to on a standard consumer contract, because you can get one for a fiver.
    The retailer is not obliged to replace the handset under SOGA, they can repair or replace-entirely their choice.
    However the repair has to be done with a a 'reasonable' period, how long was yours away for? Was it even still in warranty? If not, it's not Voda's problem, as the handset is not leased, it's yours from day one, and after the warranty expires you are liable for any repairs.
    Cancelling your DD was the wrong option, and inevitably results in a trashed credit record and a DCA getting involved.
    Swapping the SIM to another handset to test it is the very first thing to do, why didn't you just unlock the other handset and use your Voda SIM in that?
    No free lunch, and no free laptop ;)

    If so, when?

    Also did you say you called to log the issues about the phone not working and did they do any question/answer checks regarding what was happening with it?

    If the phone was faulty and under warranty it could have been sent back and you could put the sim card in another (unlocked or Voda) phone and carried on as before untill your phone was replaced or repaired

    The problem you have is that it's the network service you are paying and liable for not the phone.
    If you choose not to pay you are breaking the contract and the full amount becomes payable. Hence the debt collectors and the strike against your credit rating etc

  • The retailer was Carphone warehouse in December 2010 and they advised me that I should report the issue to Vodaphone for a replacement.

    I did call to report the issue and from memory (as this was very many months ago) I was asked some questions relating to what was happening and was told that someone would get back to me. After that time there was no further progress with V so I wrote to them asking what to do next on several occassions - again without reply.

    There were no repairs authorised either by me of V and I do not know if the handset was still under warranty

    The 12 month warranty would have run out in Dec 2011 ...however it might have been covered by the manufacturer for 2 years depending on phone etc.

    If they didn't get back to you it would have been best to chase them up or go into one of the shops to sort it out.

    From what you have said I doubt very much you have a case to justify removing the strike against you credit rating and sorry to say that you do owe Vodafone I'm afraid.

    Am I missing something here? Is it not CPW (being the seller of the phone) who are responsible for any replacements under supply of goods?

    ETA and the manufacturer of the phone to fix under their warranty?!

    They just fobbed you off. Their own warranty is 24 months for many makes and 12 for some.

    And this warranty is on the top of the statutory rights that you have against CPW under the SOGA.
    Vodafone that you blame have nothing to do with your handset and have no any obligations.
