eBay seller gave refund then posted expensive item anyway

If there is any whiff of a scam i think you should report it to eBay for them to investigate and advise you what to do.
Otherwise, I suggest contact the seller and treat them as you would wish to be treated, especially if they are inexperienced. eBay is not the high street, and the same rules cannot be applied as matter of factly as you suggest eg. not having to pay for unsolicited goods.0 -

there is this myth that ebay it's a world to itself...
if the seller is a business seller (sounds unlikely in this case, but you can't judge by the number of items sold) the same rules apply to high street and ebay.
For private sellers the law of the land still applies, i.e. someone can't take your money and not send you the goods.
If they sent it by mistake I assume they would still be entitled to have it back.
I don't understand all the fuss and arguments about a very simple matter...
If it was me in this case I would write to the seller and tell them than unless I received the money to send it back within a week (or make alternative arrangements) I would assume it's a gift and keep the item.
Wait a week, after that unwrap the item and use it.0 -
Im no expert but here is my take on it all.....but dont shoot me if you dont like it.
OP purchased the item with a pre christmas delivery.
Due to weather item couldnt be posted to arrive in time for christmas.
Seller offered to send anyway to arrive after Christmas but OP refused and requested a refund.
I think in this situation ebay would keep there sellers fee and the seller would be out of pocket (maybe not to the tune of £10).
All but what we assumed to be the sellers fees are refunded.
Afew days later the item is sent, apparently in error, and recieved by the OP.
I would think both morally and legally the OP should immediately contact the seller and tell them what has happened as they may not have realised. (We have to assume we are dealing with stupid people all the time these days Im afraid)
Then for the provision of the P&P cost the OP should offer to send it back if the seller wants it.
It after 7 or 14 or however many days the OP wants to state in there communication they havent been either given the money to or received any instructions then maybe the OP can morally and legally?? keep it.
Other than doing it that way I cant see how OP has any right to keep it.
Bit harsh to call OP a theif maybe but I guess we deal with these people on a dailly basis in life.
Anyway Im about to start rambling on so Im offski.

Maybe the OP has already decided they want to keep the item, moral implications be damned. And they're not looking for an opinion as to what to do, they're looking for someone to tell them that they're right to do this.0
