eBay seller gave refund then posted expensive item anyway

If you dont want the item, a simple email to the seller informing them that you have got your refund, but the parcel arrived, that you are more than prepared to send the item back for them once they have sent you the £10 cost of postage, should be sufficient enough to leave everybody happy.

Take a look at the OP's first post- the OP clearly started this thread in the hope that the answer to the original question would be yes, they SHOULD keep the item AND the money
I fail to see how this would ever have been even close to a scam as the seller hasnt emailed to ask if you recieved it. It is likely a simple error on the sellers part which you are now taking advantage of. I agree that the seller was wrong to hold back £10 if thats what happened but hey, you should have claimed through Paypal if you weren't happy.
I don't get whats so hard to figure out - you have the item AND the money when you know you should only have one or the other. A simple message to the seller could clear this up but you seem to prefer to keep quiet and hope you don't get caught - if in your opinion and as per your previous post you "think it must be a gift from the seller" then why not message to ask? Fact is you don't want to message because you want to have your cake and eat it. THAT is dishonest but hey - paint it up whatever way you like, call us righteous blah blah blah not fussed, Im not the one thats a thief0 -

May be a moot point now (and I'm not necessarily saying I agree with the OP here) but this isn't Theft, not by the 1968 Act that I learnt about anyway. Immoral, maybe, but morality isn't legisalted for unfortunately.

not that it should matter in the advice you give; the money isn't mine, it's my companies, and the small sum would be considered an acceptable loss in obtaining the item. Obviously, the item isn't mine either. And without you knowing what it is, I'm hardly gloating. And if you know what it was... you'd see I wasn't gloating.
