eBay seller gave refund then posted expensive item anyway

I'm a fairly experienced eBay buyer, but really have no clue what I should or can do in this situation.

I recently won and paid for an item (about £100 plus £10 postage). The seller agreed that she could not get it delivered to me before Christmas (she couldn't get to the PO), so we agreed to cancel the sale and I'd be refunded.

The seller didn't cancel the sale correctly via eBay, just issued a partial PayPal refund (of £100, she retained £10 to cover the eBay fees).

I know if seller had cancelled the sale correctly, eBay would refund the listings fees so seller not out of pocket, so there is no reason to retain the fee (which I know she is not legally entitled to do so as anyway).

But now the seller has sent the item anyway - after giving me a [almost] full refund. It was posted after the refund was made.

So what do (or can) I do? Do i just keep the item and keep the refund?

Has the item been sent unsolicited?

  • Tell the seller it has arrived and pay her the money you had refunded.

    You got the item so shouldnt keep the refund.
  • You can't really have both! If you want it, repay. If you dont, refuse delivery.
  • I would pay the 100 back to her - you had the item before christmas - however, if you received it too late (ie bought something to replace) then I would ask her for the money to send it back - especially as she kept the initial postage
  • I would have refused delivery, but I didn't take the delivery. I had no idea that she had posted it to me.

    Can I ask the seller to cover the return postage?

    I don't understand why she sent it AFTER she had refunded me. Could this be some kind of scam?
  • I can't see how it would work as a scam. I would ask her to pay for the return as she has already had £10 off you.
  • I'm going to wait until the seller contacts me.

    If it is a scam then it is the worst scam in history - I just can't see a seller thinking - 'I'll post the item AND refund the seller' nu-uh! I recently had to contact an ebayer for an item not recieved, they kindly refunded my but the next day the item turned up so I sent them an email and gave them back thier money - it's only fair and its the right thing to do - Im not thief!

    I think must be a gift from the seller, so I'll just wait until I hear otherwise. Can't see that I'm obliged to do anything else.

    Pay the woman or return it dude, otherwise it speaks volumes about the kind of person *you* are. It's like this, if you get away with putting this eBayer out of pocket like this - bad luck will spin around and pay you back somewhere later down the line with interest. I promise you that ;-) Karma is a !!!!! like that......

    The reply will tell you your next move.
