Hi all
do any of you wonderful people have ANY idea of what constitutes
"several times throughout the day" for the purposes of DLA?
short version - ds 2 has physical disability and needs help to go to the toilet - Physiotherapist has written he needs help toiletting
consultant has written he needs help with bodily functions at frequent intervals throughout the day
decision maker has accepted he needs help to:
I am exasperated - he needs help to UNDRESS - but they think he can UNDRESS to go to the toilet by himself?
his physio and consultant have both said he needs help with toiletting - but this isn't several times throughout the day ?
are they saying that going to the loo 4-6 times per day is not several?
does ANYONE know what actually constitutes severl in their opnion?
any advice appreciated!

Has he been refused dla?or not got the rate expected?
several times throughout the day will mean different things to different situations0 -
They never read the forms properly. Apparently I'm not a danger to myself, but the 100+ scars say otherwise.
Appeal and point out each mistake they have made and they should look through it again.0 -

cheers Raz- this was after i had asked them to review their original decision - so it looks like i will have to go for an appeal tribunal

Surely he only needs to pee 4-6 times a day? He hardly needs to get undressed for that.
Obviously, if he does need to do more than pee because of his condition, that would be different.0 -

no - he doesn't need to get undressed - but he does need help to undo his trousers and then get them done up again for him
and some days he pees more often than 4-6 times !
which I still think is several !
and as for number 2's - well he needs a lot of help with clearing up after those

Well I get DLA for depression. I get the medium level payments and i need someone with me when I go out anywhere (because of risk to self). Now I said I go out twice a day and they have agreed that that is several. So going to the toilet would DEFINITELY constitute several and is an absolute outrage that they would not be able to see that. Who are these decision makers? Absolute morons?0

You need to explain why using suitable aids wont help, notice how all the things they acept he neeeds help with have no suitable aids that could be used?
where as praticly everyone of the things they say he can safley do taking his time etc have various aids avalible to do them.
if you dont mention the use of any aids they like to use that against you and assume you can do everything with aids, assuming that evern with the use of aids he still needs the help yyou need to explin to them that there are no suitable aids that will remove the difficulties and discomfort he endures doing them. and explain why each and every aid doesnt help.
for example.
going up and down stairs
they can say you could use a stairlift, maby you have pain in your hips which would mean evern with the use of a stair lift you would still need help gettin on and off the lift etc0 -

You have no right to make decisions or judgements about someone you know nothing about.
And you are right, you arent wiser at all.
My original statement stands. QEDThe DWP = Legally kicking the Disabled when they are down.0
