A quick question if anyone can advise, do i send my 1st letter claiming charges back to the trinity road halifax address or to my local branch where account held?
Any advice appreciatted!
I'm claiming for 4 different people (4 banks), and starting another 2 at the weekend for 2 more people. I've sent all the letters for all the claims to the persons local branch. This has worked fine in every case. Just make sure you send all the letters recorded/registered delivery. How many surrealists does it take to change a lightbulb?

I'm hoping you can give me some much needed advice.
I have had a Halifax account since the start of my degree in 2002. I had an arranged overdraft limit of £2000 which I used up to around £1000 throughout my course until this year when unforseen financial issues forced me up to the limit. I graduated in June this year and my account changed to one of their regular accounts in Septemeber without my knowledge and my first interest charge was debited. I was charged around £29 each month since.
I have found it very difficult to find a job since and have had to rely on going over my agreed limit to £2600. However around half of this is due to their charges for each transaction (£30 each time).
I've printed off my statements from online banking and worked out that of the £600 that the bank is now demanding from me within 5 days, £237 is actual transactions and interest payments and £360 are charges for going over my overdraft limit, which shocked me. I have managed to borrow £600 from a family member to keep them happy for the mean time.
Do you think I have any grounds for claiming all or even some of these charges back? I live in Northern Ireland and I'm not sure if the legislation is different for these matters over here.
I am also concerned that they may close my account and demand full overdraft repayment. I have had other credit problems recently and don't feel I would be able to transfer the balance.

The differences in NI comes when it goes to court there is a link in Martin's article to the NI court pages but the initial steps are the same.
As you have the initial information you can send off the first letter asking for these charges back.0 -
Hi y'all, thought I'd set up a little diary to get me through my claim with the support of people who've already been there, and to ask advice for any glitches in the process. I thought it also might help those who are also undertaking the process but unsure of starting.
Bank: Halifax
Amount owed: Not sure yet! I'm estimating about £500-£1000 but as I was such a poor MSE before I found this site, it could be less, it could be more, I just don't know until I receive those darn statements!
I sent off the letter for my statements on 16th November, and as I can't find my cheque book, I wrote in there "I am aware that the information commissioner allows you to make a nominal charge for this service, and you may take this letter as my authority for you to deduct this sum from the above account, up to the legal maximum of £10.00" as I have seen advised elsewhere.
Yesterday (29th November) I received a lovely letter back saying that in order to send me my statements, they must make a charge of £5 and could I please contact them to give them permission to take that out of the account.
Smells like timewasting to me! OK, I'll play.
I will write back to give my permission today.... Luckily they had a readible named signature on the letter (scanned of course), so will write back directly to that person.
Or should I just call them??? And is this still part of the 40 day deadline? Should I remind them how many days left they have? And do I count weekends into the 40 days?0 -
I would phone them as you have a name to speak to and then you're more likely to get the information you need quicker.0

Did my court claim to halifax today, they did offer to settle at around 60% which was quite tempting so close to xmas but i've gone ahead with the claim - will let you all know how i've got on!0
-
I think this must be the worst time of year ever as the temptation to settle must be greater, good luck0
