Yes, you can claim all the fees applied to your account, even if you dont have an agreed overdraft.
If you have all your statements and know how much your charges are you need to send them this 1st letter HERE including a spreadsheet of your charges HERE
If you dont know what your charges are you will need to Send this request including the £10 fee to the banks registered address, using the letter HERE
Remember to change the details on the letter(s) to your own circumstances and always send by recorded delivery so you can track if they have received it!

Thanks - It was a DPA request. I sent the 1st letter on 30/8/06 and a follow up on 25/10/06 but so far nothing. I sent my £10 cheque and posted them both to the correct address (used the link found somewhere else on this site)
I didn't send them by recorded or special delivery but kept copies and dated them0 -

It's a good idea to send Recorded delivery. This way, you can check it has been received at the bank. If they deny having got the letter and you cannot prove it arrived, you will have to start the 40 days again. This probably won't happen in most cases, but alot of people have been asking about how quickly they can get their money, and this kind of scenario will only delay matters. If you think appropriate, you could also add the cost of your postage at the court stage.0 -
hi im really new to this board and have been reading some of the posts about reclaiming bank charges. I am definately going to do this as the halifax have been so unsympathetic wit me, in june 2005 i had to give up my job as my 3 year old daughter was diagnosed with leukaemia, my husband took a lot of time off work and the halifax stung us so bad and wouldnt help us at all, i rang them one day and said look can we please make an arrangement to pay as our charges are high and if you take all the charges out then we will have no money for food and nappies(my daughter had just turned 2 at the time so was still in nappies)they said, im sorry we cannot do that, i suggest you take a look at your budget, and find where you can make changes so this situation doesnt happen again, i was ready to put my head in the oven, and over the next few months while she was really poorly, they kept charggin and we got into a bank charge spiral, in the end our account stood at 1,900 over drawn as they kept charging and chargin in the end we switched to the hsbc bank, they threatened to take me to court for the money, and wanted me to pay 50.00 per week at our local branch, i have to admit i just buried my head in the sand with it, ive nearly lost my baby girl twice since then and i havent been able to face it till now. Do you think they will take this off my credit rating if they agree to give me some money back?many thanks. deb0

As Nickmack said, you should send every piece of correspondence by recorded delivery at the very least, otherwise should you eventually need to go to court you won't have any evidence to back you up. I'm guessing they haven't cashed your cheque either then. If they have cashed it then thats proof of receipt and you can complain*. If not, then start again with the DPA request. Ring the bank and tell them cheque xxxxxx was lost in the post and they should cancel it for free. Use the proper template for the DPA request letter as well.

If the bank fails to supply you with your data then you should complain to the bank. Keep your chin up, I was in a similar position on, had to start my maternity early due to sickness and was on unpaid for 6 months, my deadline for the Halifax to reply to my claim in court is tommorow, go for it, especially for your little girl and hope she is doing ok now

I sent off for my statements going back to 2000 and they were recieved after 35 days without any trouble despite my branch manager telling me they charged £5 per sheet for requested statements a few weeks ago, I have now sent the second letter requesting £2,786 in charges taken since 2000 on one occasion they took over £200 in one day which thier letters say they will not do, they should have recieved the letter today so i await thier response and will post the out come here.
Dont know if i was right but also had a debt collection agency ring me telling me they had put a £61 charge on a debt so ive requested an accurate breakdown of that cost as i believe it is an illegal charge it has certainly thrown them thier centre manager is sending me a letter.0
