    I have just sent my third letter to HALIFAX today. They have offered me 2 'goodwill gestures' so far and its not even half of what I'm owed. My bank charges came to £724.00 and my interest comes to £794.37 grand total of £1'518.37, they have offered on both occasions no more than £390. Can anyone say that is fair, especially with the amount of money they rake in on a daily basis. No wonder they are settleing out of court!!
    I've wanted to cave in a couple of times but I'm not going to.

  • Yes, I mean 1990 (when the account was opened!)
    Would I be wise to claim further back than the 6 years that most people do?
    (In 6 years I have accumulated £500 odd of charges with interest it works out just over £700)

    Six years is limit. There is a Limitation act of 1980 but people have claimed further and won. You need the CAG for some specialist advice if you want to go further back.

    Have you started legal proceedings yet ?

    If not how did a claim of £794 with interest become over £1500 ? the 8% interest should not be claimed until court proceedings. I apologise if this is the case although it still seems very high.
    My present claim with Barclays is for about (without looking it up) £3700 plus about £150 in interest plus about £500 in compound 8% interest so I would like to know how you got this figure?

    Halifax offered me £92 on a claim of £1500, I thought that must have been the lowest offer percentage wise but it was not. Someone was only offered 2% on their claim.

    If you do it correctly the Halifax will cave in. They are the the best ones to go after.

  • If I take it back as far as 1995 (when the first charges were applied) the claim amount including interest doubles (another £430 of charges and £300 odd of interest)

    Alternatively, I could round it to 10 years and still get most of the charges, £380 of them plus £260 interest were from 1997 to 2000)
    This would give me a total claim of approx £1300

    Suggestions on what I should do would be greatly appreciated

    The interest quoted is from the online calc here at mse website (based on 8%)
    I dont want to go to court if I can help it, what percentage of interest should I be charging?
  • I wrote to Halifax to recliam my bank charges over teh last 6 years, in total I worked out they owed me £600 (including interest). The have now wrote to me offering me £189 in full and final settlement???

    Not sure what I should do so your views would be gratefully appreciated.

    This really depends if you want to take the matter further. Are you fired up enough to go for it ? if not take the offer. If you are up to it write to them and say you will accept the offer as part payment but you will be persuing the rest through the courts. When you send the court papers you can add on the 8% interest and it will be more than £600. They wont send the part payment so dont expect it. Its down to you really.

    As I said earlier their is a limit of 6 years. People have claimed further back, its really up to you. They could fight you in court on that point alone.
    You must really know what you are doing before you embark on this.

    Yes it is 8% interest. People have even pushed this further. But 8% is considered to be a fair amount. If you want to stay out of court, only going back 6 years and claiming 8% interest is the safest bet.

    Having asked, by letter and telephone, the Halifax for a refund on the charges that they applied to my account, which they refused, I decided to look back over this year and make a request for them to refund those.

    Here is the letter that I will be sending to them...

    Dear Sir/Madam,

    ACCOUNT NUMBER: xxxxxxxxxxxxxxx xxxxxxxxxxx x xxxxxxxxxxx


    I am very disappointed in your response to my letter dated 06/11/06.
    I now understand that the regime of 'fees' which you have been applying to my account in relation to exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent Consumer regulations.

    It has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary.

    I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

    I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

    I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them.

    Your concealment of the true nature of your charges has prevented me from asserting my right until now.

    I calculate that you have taken £330 plus £28 which you have charged me in overdraft interest for the sum which you have taken. Total £358
    I am enclosing a copy of the schedule of the charges which I am claiming.

    I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.

    I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.

    If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

    After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline.


    The above, I think, gives them time to respond to my new claim of the charges that they have made this year and if they do not respond in a positive way then I will send them a letter informing them of my intention to take them to court.

    I have tried my best to read as many posts here and the great information found at the consumer action group forum, the templates have been of help, but I would still appreciate any opinions on the above letter and my proposed action if it is not successful in getting my refund.
