    If it's an official address of the bank, it should be fine. Don't continue to use Scottish addresses if you're in England though. When it comes to Moneyclaim, you must enter an address in England for the defendant.

    Hi Yes I claimed over 2 thousand pounds with guidance from Martin, bless him, earlier this summer. It took about 9 weeks to get the money back IN FULL. I did eventually go to the Small Claims Court and they did not contest it as it would have cost them more to defend it even if they had won (their words)

    Well I heard about this forum and the whole legal situation over the last few months and it gave me some food for thought. I asked the Halifax to send me my account statements over the last three years. Well it took five weeks to get a copy sent out after many phone calls and promises of receiving them in a few days. Well to my surprise I relieved the total figure I had paid in charges was £1,253. I couldn't even believe it was this much. So I thought I would chance my arm and give them a call. Well two days ago I done this and the person I spoke to on the phone was helpful, he took a note of all my details and then went away to speak to someone. Came back and said we would get call the next day from another department giving us an offer. We had the choice of taking it or knocking it back.

    Well the next day came and no offer was present, so I was a little bit upset to say the least, by the time I did call them the office that dealt with this situation was closed. I phoned up this lunchtime to find out what was happening, when I got through I was told that no record of my call was found. So I spoke to the relevent agents today just twenty mins ago, they said that I had to send it in by writing. So now I'm back to what feel is like square one.

    So what do I need to do apart from the obvious and send them a letter. Where is it to and what is the quickest I could get a first offer if I made sure they received it by the start of the next week?

    Again any help would be appreciated as this I am hoping could go towards Christmas for the kids.
  • Have you actually put in a claim in writing or just spoken to people on the phone? To be honest I would put in an official claim in writing by following the steps in Martin's article and using the templates rather than mess about on the phone.

    You could put in that letter as Martin suggests that you would accept a reasonable offer of 75%?

    edited to add, I can see that they would expect something in writing to substantiate your claim.

    Hi Everyone

    Could someone answer this question for me, why is it that the banks pay some people without a fuss, yet make it really hard for others to reclaim their charges. I'm with the Halifax and they owe me £1756.00 wrote the first letter received a standard letter saying under their terms and conditions etc etc they are in the right, sent second letter last week and their 7 days will be up on monday before i go to Moneyclaim, i'm really annoyed with them being a single parent of 4 kids can't really afford to let this one go.

    Please can someone answer this one for me.

  • Cheers for the quick response that is the current stage I am at as we speak. If I could get that ammount I would be quite happy with that. I was just curious about the time scale with Halifax. If they give a decent offer after the first letter if any offer.

    This highlights why you should do everything in writing. You need to follow the instructions in the article and start your claim. Depending on the bank and your willingness to accept a partial amount, you may get some money before Christmas but don't count on it. If the bank want to string it out, there's little you can do, you can't cut corners in the process or you risk wasting time and money rather than getting it back.

    I think it's about trying to bully you into dropping the claim or accepting a partial offer. Even if just 5% of people accepted an offer, it will save the banks a fortune.

    It may seem frustrating, but you have got the law on your side. It's perseverance, but worth it in the end.

    Reading this thread with much interest and seems it is well worth writing off to my bank (Halifax).
    However firstly im not on the electoral roll as yet as i messed up when moving house so getting another bank account might prove difficult although i should be on it some time in December when the record get updated.

    My main concern is that i have a Halifax Visa Credit card. If i write and ask for charges, can they not only close my current account down but close my visa account and ask me to pay up in full. Dont want to get back a few hundred only to have to pay out a few grand.

    Anyone else had this kinf of problem

  • The Halifax c/c seems to be a separate business from the banking arm so I wouldn't think they will close your c/c just because you claim your bank charges. By the same token they are unlikely to ask you to close your current account if its not a great deal of money that you are claiming. Not guaranteed of course but you would get 28 days if they do suggest you close your account.
