Part of the reason he lost was lack of preparation, and partly was a sneaky move on the banks part (which they haven't repeated because it is easily defended).How many surrealists does it take to change a lightbulb?

The statements I requested from HALIFAX a week before Christmas came today January 11th 2007, so hopefully you shouldn't have to wait too long. There were 110 pages all sent together in a tatty, half-opened, hand written brown envelope. Didn't for one minute think my statements would be in THAT! Anyway, I've got them and my charges (without interest) add up to approx £370! Adding interest, with help from the MSE interest calculator, brings the total up another £96. Although this is peanuts compared to what some are claiming it's is a major amount of money to me. Actually, I'm quite proud of the fact that my money managing skills have improved (posh way of saying I rob Peter to pay Paul but know when to pay Peter back!!) Only 2 charges in the last 2 years! And I don't have any loans or credit cards. Feeling quite pleased with myself!0

I stand corrected. I thought they got the case struck out. Unfortunately it serves as a good example of why you should tkae it seriously and make sure you understand what you are doing.

I've received a copy of the court Acknowledgement document which shows Halifax have acknowledged my claim. The online service states they have 28days from date of service to submit defence, i.e. the 31st jan is their "final" day.
i noticed on the acknowledgement document that the halifax have ticked the box labelled "i intend to defend the claim in full" or words to that effect.
does that mean they are definitely going "all the way" and i should prepare for a court visit?
if halifax do make an offer before the deadline will it just magically appear in my bank account or will they write to me directly offering settlement?

Lots of banks have entered a defence, but still paid up in full before any court hearing. You should still prepare yourself just in case they do go all the way (unlikely, but possible). Read up as much as you can so you fully understand the law behind your claim, and what's required in the court process.
Even if they put the money straight into your account, they will still write to you to inform you of their offer (you need to let them know you are accepting the offer). They may instead send a cheque for their offer along with a letter.How many surrealists does it take to change a lightbulb?

The story:
Requested statements end of Nov 06 and they arrived start of Dec 06 (Got them free due to an error on their part!)
Sent 1st letter and got an acknowledgment of letter received on 04 Jan 07.
Halifax phoned yesterday and offered £200 to start, with some banter I got them up to £450, but I still declined and said if you offer £500 I’d accept.
30mins later they rang back and offered the £500 which I accepted. (Saves me 2nd letter and going to small claims)
Halifax is sending out a letter for me to sign & date. Once they have received this back the money will be in my account 10 working days afterwards!
