  • Any bank can and may close your account, this is why Martin suggests you open a new account in readiness.

    Your loand and mortgage are different agreements so shouldn't be affected by your reclaim. Any successful claim is likely to be put into your account and so reduce your overdraft.

    wantitback, the £12 was a recommended charge for credit cards only and doesn't affect the bank charges so you could make a second claim.

    I noticeyour letter was also dated 2nd January just like myself.

  • Hi,
    I sent the letter to the halifax requesting they refund my bank charges-(£1500) with the interest calculator.

    I have today had a letter back advising me that they will not be refunding and that under the terms and conditions of the account they can levy charges when insufficient funds are in the account. They will not refund as there is no error on their part...
    Is this a normal response and are they right?

    I have telephoned Halifax on the 203040 number.

    They will not send my statements unless I write in.

    I have a question, but need to give you the background to my claim. So I am going to copy and paste a few of my posts from the CAG forum where I haven't had a reply yet.

    Hello All.

    Let me bring you upto speed with my claim with Halifax Bank, as I do need your advice.
    --
    (*)29th September 2006 - Data Protection Act/S.A.R - (Subject Access Request) letter sent to Halifax

    (*)12th October 2006 - 14 day reminder letter sent to Halifax

    (*)15th November 2006 - Spoke to Halifax Data Protection Act department who said they would get the requested statements to me asap.

    (*)28th December 2006 - Sent final demand letter stating that I would inform the Information Commissioners Office and consider legal action.

    (*)2nd January 2007 - Submitted complaints from to Information Commissioners Office.

    Right, well took matters into my own hands today, rather than waiting for the Information Commissioners Office.

    Today I contacted Halifax by ringing their main switchboard. Asked to speak to the Data Protection department to be told that they couldn't put me through as it was a staff line only.

    So the lady I spoke to asked me what the nature of my call was to direct me to someone more appropriate.

    I explained the entire issue of non-compliance with the Data Protection Act etc, and eventually I spoke to some form of low level manager.

    She then spoke to the complaints department who checked my account and had no record of my two original Data Protection Act/S.A.R - (Subject Access Request) requests. Although they had my recent corrospondance which was the DPA Default Letter.

    So to cut a long story short they are sending me my statements out today and should be with me within 3 working days. So a positive result, if they do turn up as promised.

    So next stage after receiving them is to send them a LBA.


    Update:-

    I received an A4 printed sheet today from Halifax listing all my charges from the past 6 years. No statements or anything else, but it does clearly breakdown every charge applied to my account. So I am happy with that.

    Now, I am going to write my Preliminary Letter, however I have a query regarding addressess.

    This charges sheet came from the department I spoke to yesterday, "Customer Relations - Leeds". Do you think I should send my Prelim Letter back to that department or stick with the Trinity Road address, or send to both?

    has any1 got online banking??? How can i go back further as i only seem to be able to view my statements for the last month.

    Which is where I planned to send mine. But with me dealing with the Leeds Office and them sending the charges list out to me, I wonder if it maybe best to deal with them instead?

    hi there,

    i handed written req for refund into my local branch. they were very helpful, and promised an acknowledgement within 48 hours. sure enough a politely worded letter arrived stating that they had transferred the matter to -

    Customer Relations Dept in Leeds. who will investigate and reply back to me directly.

    - handing it in at my branch has saved time and postage.
    - got me an written acknowlegement of my letter

    I hope that the Halifax don't clamp down on this user friendly approach in their branches as it makes things easier for us i feel.
    Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
    MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
    Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
    Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
    Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
    Halifax 2: Ongoing....

    I am claiming bank charges of £158 from Halifax plus interest - had all my statements so didnt need them to send them to me.

    Got response to 1st letter offering £60. Wrote telling not accepting and got offered £120, told them still not accepting and if dont receive letter offering full amount (including the interest calculated at the date of 1st letter) within 21 days then willl issue legal proceedings. They responded telling me that have to go through the Financial Ombudsman now, but will ignore that and phone them to warn gonna start legal proceedings, then if dont give me full amount then will go ahead.

    Only setback may be that I have applied for numer of credit cards and found out that the issuer is actually Halifax and have got about £10k at 0% which am doing the credit card shuffle and putting in high interest account via Egg card, so hope if they want to close my accounts they dont cancel my credit cards or the 0% offer. ANY ADVICE ON THIS APPRECIATED.
