    Hi i got the exact same one and was told by everyone on here to press on and send the threat of court letter so that already in the post:p just waiting for 14 days then its of to court i go.

    Hi thanks for that, let me know how you get on & if they make you an offer before your 14 days, Im getting fed up of waiting for the courts on my Natwest claim, its bin acknowledged since may, defence entered, still no date. Hope I dont have to go through the whole carry on with Halifax!

  • After four months of being ignored and being at the acknowledgement stage in regards to court action, a letter from the bank arrived saying the majority of my charges and interest will be paid into my account.

    Checked my account and the money was there. The bank said in there opinion I was not entitled to anymore.

    Help I need please, is how to word the letter, informing the bank, that this money is part payment and I will be pursuing the outstanding balance by continuing my claim.? Also, can I ring my local court handling the case, updating the claim figure?.

    I've got this template from somewhere:

    I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges + statutory interest + court fee.

    I have also found this one:

    I" respectfully decline your offer of Full and Final settlement and request, once again, that you return to me all charges imposed on this account.

    I will accept the sum offered only as part settlement without prejudice and on the clear understanding that I will continue to pursue recovery of the remainder with a County Court claim.

    If you do not accept my conditions, or you do not respond within 7 days, I wish to stress that I do not accept your offer as Full and Final settlement and the money transfered to my account should not be viewed as my acceptance. I hereby authorise you to remove this sum accordingly."<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" /><o:p></o:p>


    I believe you can just ring the court updating the figure, the only problem is that that costs £35, and I think it is non-refundable.

  • I have been trying to claim back my charges from the Halifax and everything had been going to script when they sent me a letter saying that I wasn't entitled to a refund.
    I followed the instructions, editted and sent the template letter on the site stating they must reply in 2 weeks or I will begin court proceedings. It has now been 4 weeks and still no reply. What do you recommend I do next?

  • I telephoned HBOS yesterday as I wrote to them on the 18th June and they say they received this letter on the 20th June 2007 This letter was to say that I did not agree that their charges were correct and that I expected them to refund the money owed to me and I gave them 14 days to reply. I had not received a reply as of yesterday, so I telephoned them and they then said they had until the 7th August to reply to me as the FSA have given the banks 8 weeks to reply to requests for reclaiming bank charges. The clock starts when you request your charges back, then stops when they reply to you, the restarts when you reply to them. This is where they get until the 7th August to reply. I am now going the fax them to tell them that I am not prepared to wait another 4 weeks, they have already had 3 weeks and if a reply is not received in the next seven days, I will take court action. Has anyone else been told about this 8 weeks that the FSA have given the banks.
  • I have put my request in for the £650 they owe me and this is the general gist of the letter I got back

    Basically they are unwilling to repay me because I signed an agreement at the start of the account agreeing to these charges

    what action can I take to get round this without threatening legal action ?

    Any help is much appreciated

    They probably mean the Terms and Conditions. I would ignore it and plough on.
