  • I have has a letter back from HBOS and Abbey saying that when I took the bank account I agreed to there charge sand they keep me upto date with any new tarrifs so am unable to reclaim any charges
  • Hi Everyone

Wonder if anyone else has experienced this with Halifax? I sent off the first letter two and a half weeks ago asking for about £600 back. I still haven't received any notification from them. I don't know if it's cause of the postal strike or if they're just ignoring.

Has anyone else not heard from them and had to just send the next letter threatening action?

    Any help would be wonderful.

    Many thanks

  • Hi, I recently have been going through the process with starting to claim charges from Halifax PLC.

As most people i received the standard letter stating they will not refund the £240 they owe me.

I sent the next letter requesting a reply within 14 days time otherwise i will follow the court process.

They did not reply hence i started a claim through moneyclaim website and was issued on the 3rd July.

Two days before they where officialy served the notice i received a letter offering me £98 as a good will gesture, they say that it will be in my bank in 14 days time unless i contact them to disagree.

The dilemma i have is that do i contact them to say i object and i have already started proceedings or wait? Reason being is that the time they have to defend/accept receipt of my court notice runs out two days after they will be paying the money into my bank!

I am a man of principle and although its only a small ammount i am claiming will not accept anything less other than what i have asked for. I just need some direction on this one if possible.

    Comments would be most appreciated.

    Many Thanks in anticipation

i would call them say u wont settle for anything less then x ammount if they say no then continue with the court, dont stop court unless they pay u what i want..... or what u will accept

ring them tomorrow say ui wont accept it if they say okw ere pay uw hat uw ant then when u have payment close court case, also ask them to put that in writing ect,
if they say no we wont go any higher, then send them a letter stating u are not accepting the £98 and continue with court

DONT CANCEL COURT UNLESS U HAVE IT IN WRITTING THEY WILL PAY U X AMMOUNT OR THEY HAVE ACTUALLY PAID U :D
  • Many Thanks

I will give it a go and let you know!

Your first letter was this asking for statements or first letter asking for charges back? the whole 8 weeks thing seems to be hanging around, though when I asked for money back I gave them a week to reply and sure enough i had one. That was back in May though?

You could always ring them to see if they've received your letter?

Did you put a time scale for them to reply back to?

    Morning All,

Just spoke to Halifax re; credit card account, they have offered me final settlement for £562. The debt is £1453. He said that this was the final offer as it was 1/2 of the total debt and they will not change this amount, due to the bank changing the charges to £12 last year from £30. Do i now proceed with MCOL or should I settle?

    Many thanks
