    I had the same reply from the Halifax, but just followed the details on here ,filed it with the court and now they have paid out....it wasnt a large amount £200.63....but 2 other claims of mine have paid out after going to court...when I say going to court..they were filed with the court but all the Banks paid out before court dates.....we have one more to pay out and we will be over £9000 better off...

    Dont let them put you off ...keep fighting for YOUR money....

    Thank you so much, I felt really down when I got the letter. I will fight on, and proceed to take them to court.

    After a lot of messing about (branch 'lost' my claim), I have resubmitted and had the following letter in 3 days...
    "I have carried out an investigation of your complaint and I am satisfied that the charges have been correctly applied to your account"
    What do I do now? Take them to court? Is that process detailed on here?
    I am feeling very aggrieved and stressed by all of this. Hope some one can help. Thx!

    Send them the second “Letter Before Action” letter.

    At this point, you have to decide between referring your claim to the Financial Ombudsman and starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. They charge the bank involved £400 for each complaint they accept. However, they cannot award interest like a court. Their success rate is good but, if the Financial Ombudsman is unsuccessful or the settlement is unacceptable, you can still start court proceedings.<O:p</O:p


    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, you can then refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by your deadline, then start court proceedings on Money Claim Online.

  • Over a week since i spoke to a Kevin (anyone spoken to this guy?)

    Hoped to receive some letter as I've waited nearly 6 weeks since asking for a revaluation of my claim, 2 chaser phone calls. Iknow they have 8 weeks but...it's taking it's sweet time.

    to the people currently waiting for mcol cases. We went down this road as we were getting nowhere with halifax. They acknowledged claim a day or 2 before 14 days was up so got another 14 days to file a defence. The day before this was up the money in full plus interest and court fee was in our account. This was before we'd even recieved a letter stating they were going to pay it. Claim including interest was around £3700 so hang on in there.

    I was wondering what would happen next, as my claim on MCOL was acknowledged by Halifax on 27/06/07 - 2 days before their time was up. Now I just have to wait until 14/07/07 for them to come back with a final decision (it's a Saturday, so i'll probably have to allow until the Monday after). Fingers crossed the money will be in my bank instead of them wanting it to go to court :rolleyes:

  • Hi, further to my recent success post ive hit upon a bit of a predicament:confused: As i said before i haggled my way up to 5000 which i was very pleased with!! the first instalment was paid in last friday from the original offer and today i have 2 more cash payments which add up to the TOTAL amount i was originally claiming and not the 5000 we agreed on, bearing in mind that the time with MCOL is up today, im at a loss at what to do, im happy obviously but i dont want to be in a situation where the bank says we want our other bit of money back.......advice? shall i just ring them:rolleyes: or do i just sit on it;) still happy though:rotfl: (its an extra £900!) Cheers.

    Transfer the excess to a high interest account and sit on it for as long as you can. You'll have savings. Be getting interest on their money and above all if they say it's been a mistake and demand the £900 then it's there. You've got £5k to play with remember !! Make that £900 work with you.
