I did this and spoke to Steve who is really helpful. However he said that he was not allowed to look into my case as I had received a letter from someone called Bhekimfundo Ncube offering 36% of my original claim. He said that he has e mailed Mr/Mrs Ncube to ring me.
My claim is acknowledged by Halifax at court at present and thet have until 2nd July to put in their defence.
Getting scared:eek: .
Dont' know whether to hold out for full amount or accept their offer?
Any advice?
Further to this I got through to my reviewers number todays as Mr/Mrs NCube did not ring :mad: . They told me a letter is on the way offering full amount! :T
Checked my account and it is in there already!! Someone called Graham from the 'Steve' team sorted it.
Keep perservering. It is worth it. The banks will always give in as they don't want to set a precedent.
If they set a precedent they will have to change all their current charging.:beer:0 -
having read this thread it kind of gives us some hope that Halifax are going to pay up, their 28 days are up on Monday and if they haven't filed a defence by then then we can enter judgement for the nearly £7k they owe us, we haven't heard anything them, not a phone call or letter even offering us any of it!
So fingers crossed it goes our way!!
I was under impression most could cliam via MCOL was £5k? is this wrong? mines £5380 plus £1500 interest but I've not had the offer to refuse as of yet.0 -

That is the amount you can claim under the small claims court, but there really isn't much difference in the procedures and definately no difference in how the case will be treated.
Any claims above the £5000.00 mark will also have court fees of £250.00 instead of £120.00 for anything less, so your intitial outlay will be that little more.
They definately won't refuse your claim though. Hope that helps!0 -

I think i'm getting somewhere... i rang the 01977 again this afternoon as they didn't get back to me as promised. I spoke to a Rachel Barker who had sent the letter that i received this morning. She confirmed that there had not been any charges to my current account. I politely told her that this was wrong and i obviously had the prof etc. She told me to visit my local branch and ask them to fax the charges list to Nexus and then it would appear on their system. She would look at it Mon/Tues, call me and make an offer. I have done all of this today and the guy in the halifax e-mailed Rachel telling her he had done this and she acknowledged his e-mail. So, on Monday afternoon i will call her again to remind her. She was very nice, polite etc but i wondered whether she was trying to fob me off. I reminded her that as Halifax had now acknowledged my claim on MCOL they only had another 2 wks to sort it out and if i did have to take it further i did have all the evidence i need. So, watch this space........0 -
i got a letter on thursday offering me about 50% as a gesture of good will i phoned and was very polite, calm and slow talking and said i would accept without predudice but would carry on with my online claim for the full amount.
the man asked me how much did i want and i said all of it he said he could increase my offer to my original amount (my first letter didnt inc interest) but he could not pay it all.
when i sent my final letter because of their refusal to acknowledge that the charges were unfair, i said pay all or will go to court and add interest, and i gave them 14days so when i didnt get a reply from them i filled my online claim including interest.
i said i will carry on with my online claim then and he said ok.0 -

I would follow up the phone call with a letter though, just to put your intentions in black and white.

Having a read through all these posts it would seem that Halifax are coming up in the top five most difficult to get your bank charges back from.... if only we didn't have to struggle so much to get them too see that they are clearly charging too much!
I am not too sure what is going to happen with ours, as you are all probably aware there has been a postal strike, will this make any difference to the claims process, will the courts allow the banks an extra day to file a defence because of this?
I am also under the impression that if the 28 days falls on a weekend, the courts will also allow them an extra 1-2 days to get their defence in, has anybody encountered this yet?
I have worked it out from the 4/6 (the date the papers were served) to 28 days is the 01/07 - being a Sunday, If we have had nothing in the post on the Monday (which should also include the backlog of post from Friday, I hope), I will file for judgement agaisnt them... MCOL will either allow me to do it then or have to wait until the Tuesday...
Getting increasingly nervous about this as I have read that because the claim is over the 5k mark we will not be able to issue a warrant of execution if they do not put in a defence or pay up without going through the high courts, which of course will then involve a solicitor! Has anybody actually had to do this yet?
any advice would be appreciated as I just want to prepare for the worst!!!!

After a lot of messing about (branch 'lost' my claim), I have resubmitted and had the following letter in 3 days...
"I have carried out an investigation of your complaint and I am satisfied that the charges have been correctly applied to your account"
What do I do now? Take them to court? Is that process detailed on here?
I am feeling very aggrieved and stressed by all of this. Hope some one can help. Thx!0 -
