    I am actually a debt recovery paralegal and can shed some light on the County Court process

    LBA - 14 DAYS
    Claim Issued 1 day on MCOL (Local County Court - 2 days)
    The Defendant in this case the bank has 14 days to serve an acknowlegment of service which gives them a further 14 days to reply, a defence or an admission.


    No reply: you can enter Judgment on the 15th day
    Ack of Service: have to wait another 14 days
    Defence: They will absically roll over if its under 5k as they cant claim their costs back in the small claims court.

    All in all if they dont respond to the claim forms you ahve judgment agaisnt them in appox 14-17 days!

    Hi on the 15th day after the date of your first letter send the next letter telling them you will be taking court action if not heard within 14 days I got my offer 8 days after sending this one. Good Luck keep us posted :j

    Just called them and they are taking the exact 8 weeks to look at it! Mine will not be looked at for 4 weeks due to the back log. Ill send another letter today. I also explained to the advisor wen she started going on about the fsa that it is actually the courts who decide regarding the charges are disproporinate to the actual true charge and not the fsa!

  • This is my first post, so please be gentle!

    I sent off my £10 and request for payment information exactly 41 days ago. The Halifax received it the following day (signed for post) and cashed my cheque a few days later. I have only received the letter telling me that my statments will be sent by separate cover - nothing else yet.

    I know that just under 6 years ago (~April/May 2001) an error by my employer delayed my pay by a few days and I got hit for over £200 of charges - similar to the recent BACS problem as I understand it.

    My question is: When does the "previous 6 years date" commence. Is this from the date I asked for my statements, or from the date I issue letter #2, or some other date?

    My concern is that if the bank delays my statements much longer I may pass the 6 year cut-off date and miss out on reclaiming this amount back

    I have read all 102 pages of this thread and many of the others (including the sticky's) but do not recall seeing this information anywhere.

    Please accept my apologies if I have missed something obvious, but any help or advice you are able to offer would be appreciated.

    I just got off the phone with halifax and they say they have untill the 11th of may and so will not be makeing me an offer at this time. I rang another number and what i thought was a nice lady who said they sitll had another week to get back to me with an offer but she would put me through to some1 who maybe able to help, when after 10mins on hold the phone went dead! they cut me off! how rude hay. well court action it is then :( i not a happy bunny. kinda scared now to tell the truth. oh well here goes. . .

    (do you think it worth me given them another week & ringin back or should i just go for it??) help! :(

    The first number seems to be the most helpful one but they just seem to be ignoring the fact they need to deal with it - blah blah blah 8 weeks blah blah blah!

    I sent my letter off to halifax requesting charges an never heard back within the two week deadline I gave them so yesterday I sent letter saying I would be taking them to court if they still didn't reply. Only askin for about £400 back so would of thought they'd have said somethin. How long did it take them to reply to every1 else??

    ya i had all that they will get back 2me etc etc. It was the second 1 that seamed the nicest ( so i thought ;)) well to be fair she was nice it was the person she was putting me through to that prob hang up on me cuz they couldn't be bothered. like i said she said i had another week b4 they would give me an offer, do you think i should give them this or just go ahead? to tell the truth i don't think i can afford to take them to court just yet :(
