    I have gone through the process of getting statements,asking for settlement and after no response from the Halifax,taken court action.

    Today I received a letter from the Halifax with an offer which is about 30% of the total claimed.

    The fourteen day period for a response to the court is up on the 18th of March - four days from now.

    My question relates to how I refuse their offer. Should it be done by letter or will a phonecall be sufficient?

    If by letter then could someone point me to a template which I could use?

    Another question a friend of mine also with Halifax, is suggesting to go through Ombudsman, they sort for you but are telling her takes 8 weeks? and cut off date is 31st March for claims, anyone out there know anything on this?

    The Financial Ombudsman will take on a reclaim and yes it can take 8 weeks but there is no cut off date, please read this post by Martin.

    You can certainly try a phone call, have a look back through some of the posts here to see if people have had any success with this.

    If you are writing just say thanks but no thanks and that you will be proceeding to court. Do check your bank account as some banks are putting the money direct into your account in which case you would need to say that you accept it in partial payment and without prejudice and will be proceeding to court for the remainder.
  • Well here is my story. Sent original letter off to the halifax on 15th Jan. Receievd letter dated 19th January informing me my complaint was being looked at and will here within 4 weeks. 4 weeks passes heard nothing. Rang on 5th march and was told they has sent me a holding letter to have an extra 4 weeks to look at my claim a letter i have never received . This extra 4 weeks ends tomorrow. When i called i queried the time length as a relative who's claim was received 12feb has already been settled. She told me they are dealt with in date order I THINK NOT after reading other people have had theres settled already. My claim is for £370 not a fortune is it. When i call im holding on for ages in a line so i have faxed but they never respond. What else can i do im at my wits end with them

    You need to send the bank the letter before action telling them you will be taking them to court, you have been patient long enough!

    Again if you do proceed to court after accepting this settlement please ensure you claim the statutory interest that you are entitled to upto the date they refunded the cash. Also whnen you remove these charges from your schedule of charges ensure they are the latest ones so you gain the most interest. ;)

  • they told me they are dealt with in date order. Do the banks think we dont look at these website forums and talk to each other. I check my account twice a day but nope nothing. It's also the fact they seem to be ignoring me and were most unhelpful when i rang to query.

    Cap One: (me) 853.00 paid: 1059.05 20.04.07 :beer:
    Cap One: (hubby) claimed 718.18 13.04.07
    Halifax: 1836.00 plus int 283.82 int claimed 30.03.07
    Ikea : 324.00 plus 38.70 int (paid 340.00 20.03.07!!):beer:

  • I have posted this on a seperate thread and did not realise this post was here. Apologies for reposting the same message.

    Hello everyone, sorry I am new here and I have a quick question before I started claiming back monies charged.

    I rely heavily on internet banking and when I checked my account online it had said "Renewed Account" and didn't not see any transactions. Then there was a death in the family so I transferred some money from my savings account into this account as I knew that I didn't not have any money in there to cover some bills. Yes, I also used the telephone banking as well and it also failed to give me the transactions.

    Of course, I got charged and I fought this and the returned only 2 of the charges as a good will gesture. I was fuming at this. After to and froing with the bank I gave up and then I didn't go over my od this year and I phoned them asking them to waiver the charges and they said they can only waiver one and told me that they will not be waivering anymore charges for me ever again.

    This annoyed me. The second time I do take responsiblity for but the first time is an error in there part and they way they spoke to me was as if I was a child. I have been banking with them for 20 years and I have had bank loan, car insurance, credit cards etc out with them and when I got married I raved to my hubby about them that now we have our joint accounts with them. But they have annoyed me so much I want to try and get all the charges including interest back and then leave them. They are the Halifax.

    Do I have a leg to stand on? Thanks in advance for your help.
