  • I first phoned asking for my statements about 2 month ago, I was told that I would be charged £5 (fair do's) & that a letter would be sent to me confirming these details, on receipt of this I would have to phone up to say I agree with the charge & they would send the statements. I thought this was odd but was at work so didn't have time to argue. 2 week later I still hadn't received the letter so I phoned & spoke to a lovely lady... she said that was !!!!!!!! (only in a much nicer way) and that there were no details logged on the system. It was sorted straight away - £5 was taken & I received all the statements a few days later.
    It's unbelievable the crap they will spout in order to put you off & hideous customer service!!
    My letter claiming £564 is off in today's post!

    hi everyone
    This is the first post i've made but i've been lurking in this board for some time now. i just wanted to say a HUGE thankyou:T to everyone for all the advice on reclaiming bank charges. I put in a claim for £188 and today i recieved a letter offering me £128. Today was the day i would be starting court proceedings so i was pleased to see an offer from them. I followed advice seen on here and rang them up to say i wasn't happy with that amount. After a few minutes it looked bleak that i was going to get a better one so i told her i would be beginning the courts process today and the customer service lady backed down immediately! Asking me what amonunt would i be happy with i accepted £150!!!!!

    I have been reading through the most recent replies to the forum, and I notice sayings about 'dont wait until April' Have I missed something..?
    whats going to happen then.... I have just started with requesting my bank statments will I still be able to claim if it goes into April.?

    Hello all, I wonder if you might be able to help please? I have just received a letter from halifax detailing charges as follows;

    1) transaction paid with insufficient funds charge £30 to be taken on 17/03
    2) transaction paid with insufficient funds charge £30 to be taken on 17/03
    3) unauthorised overdraft fee £28 (because the payments above took me over my limit) to be taken on 30/04

    ok my mistake because I have 2 accounts and used the wrong debit card. So I phoned them explained the situation and asked them if they would reconsider. Apparently there were 2 further £30 charges that I didnt know about. So they have removed those 2 charges as it was my first time of it happening but the others (detailed above) will still be charged. What should I do??? Should I write to the manager and ask him to remove the charges as they are unlawful or should I wait until they have been taken and then claim them back? Ive only had this account a year but I am sorely tempted to claim back charges on my other account which Ive had 5 years because they are being so unreasonable. Please can someone advise me what they would do, I am so angry right now I cant think straight!

    I would personally treat this as the standard I want my unlawful charges back. Read Martins thread on claiming Unlawful charges.

    If you have all the facts and figures then you can then go to the 2nd letter, if not then start from the beginning.

  • Hi Everyone,

    As a newbie to the Chat forums, this reclaiming of bank charges is causing me quite alot of confusion.

    Here is where i am up to.

    I have written to the Halifax asking for bank charges to be refunded, i detailed all the charges for the last 3 years (as this was as far back as my statements went) and asked them to provide me with statments for the previous 3 years. This letter was sent to them on 28th February 2007. I recieved a response from them dated 9th March, stating it will take them 8 weeks to deal with the complaint, but they will endeavour to respond within 4 weeks.

    Now until today i was to just let these timescales lapse and then chase them up, however, reading some of the threads i see that from April they can just refund me with the "difference"

    Can anyone give me adivce on what i should do? As i would have assumed that as my complaint was lodged before April then i should be entitled to the "full amount" of charges and NOT the lesser amount of the "difference"

    Is 8 weeks just the Halifax's way of delaying things until April?

    Has anyone called and complained about the 8 weeks timescale and consequently had their complaint hurried along?

    I have posted here before but cannot find it?? being a NEWBIE!!

    Anyway, I would like to keep you posted on my progress and also ask assistance along the way.
    I too am a hoarder and had exactly 6 years worth of Halifax statements on Sunday 11th March, I went through them all to find £1790.00 worth of bank charges!!
    Monday 12th March, typed up Template letter 2, attaching a schedule of Bank Charges, with dates, amounts and Statement no. (maybe this will help them find them)lol.
    I sent the letter recorded delivery Monday 12th March, now my question here is do I wait 14 days from the date on the letter before issuing the Template letter 3 (with court action) or 14 days from the date they sign for receiving my letter?
    Also, if they reply with their standard 8 weeks to resolve letter, can I just issue court action letter on receipt of this, or do I have to wait until the 14 days are up?
    Sorry if thats a little confusing, need all help can get!!

    The date they receive it.

    You should wait the time specified in your letter.

    They have 40 days, wait until that is up before you let them know they're in breach of the DPA and inform the Data Commissioner.
