Thanks Rex. I am watching status of claim and hoping for a brilliant birthday present from the Hallifax(Ha Ha). this is a great forum and has helped me loads. keep up all your hard work.Rex_Mundi wrote:Do not panic!
Halifax have not taken one single case to a hearing to defend their charges. James is mistaken by thinking he read this somewhere.
You stand an excellent (99.9%) chance of success.0 -

Hi...
My Halifax account is also in joint names with my wife. I addressed all my letters with only my name and had no problems. Use both if you're unsure. See my post below for my result.
Cheers...Stuart

Evening all - new to the site so please be gentle with me!
I was just wondering if anyone else has suffered the same experience as me with the Halifax, posted off my letter requesting my statements a couple of weeks ago (still waiting) but failed to notice that my current account card was due to expire at the end of Jan 07... After a very embarressing weekend I got in touch with them and said "where's my new card" - "oh sorry about that we'll get one out to you in 7 - 10 days...." What turned up, with no explanation, was a CashCard with my overdraft facility completely removed, it's not even a cheque guarantee card!! Visit to local branch, who admittedly tried their best, said your account has been downgraded because you exceeded your overdraft twice last month!!!! (Once by pennies which they charged me 30 quid for!!!)
Is it me or is this just an uncanny coincidence???
Will be opening a new account elsewhere tomorrow!0 -
Hi all...
It's been a good day :j
Yesturday I posted because I was not sure whether to accept an offer from the Halifax.
Well I didn't...and boy am I glad. My total claim was £4174.68 which includes the interest. I said I would accept the lesser amount of £3759 which is the total amount less the interest.
Recieved letter yesturday from Haliax with offer of £2510. Rang them this morning and said not good enough and that I would only settle for the £3759. The guy put me on hold, came back 20 seconds later and offered £3000. I was tempted but stuck to my guns and said it's £3759 or I'd claim the full amount in court plus court fees. He said he'd ring me back this afternoon after looking into it. He was good to his word and rang at about 3.30pm and offered the £3759, which I accepted. He's posting out a new acceptance form which will get to me no later than Wednesday next week. Money will be payed into my account 5 working days after they get the acceptance form back.
All in all a good day. It goes to show that it pays to be strong(at least it did in my case).
I requested my statments on the 8th Jan and have reached a verbal agreement today 1 month and 1 day later.
Hope this tale is of some encouragmnet to others. Go for it...it's your money.
Will be having a few of these tonight
Thanks too all who assisted and helped me along the way :T

I'm relatively new to all this but enjoying it lots after years of being at the mercy of banks/building societies. Northern Rock are paying back the difference between the exit fee they stated at the start of my mortgage and what they actually charged me.........feels good......I have sent a letter to the Halifax asking for my charges back. I have been told that they have referred my complaint to the relative department but have noticed that they removed my overdraft facility overnight without notifying me. It's only £50 anyway and I noticed this in time (it was a usefull buffer) and was able to transfer money in to cover the £10 or so I may have gone over for a day. I think this is tit for tat and out of order really but they seem to take their ball back if you make a claim so take Martin's advice and open another account elsewhere before you start the process. Good luck everyone. I'll let you know if I get my money back0

Advice welcome here. My extortinate Bank was The Bank of Scotland, now part of HBOS. All the banking I'm complaining about (£1300+ worth of it) was done in Glasgow but HBOS is based in England and I now live permanently in England too.(last 6 years) The Scottish courts have set a claim ceiling at £750 so can I use The English system ? The stage I'm at is that I've worked out all the charges and the interest, using the calculator, sent off the claim this week and received an acknowledgement this morning. I need to know which legal system to use if they don't just roll over and stump up. (I wish !!)
Anyone know ??
Cheers. Bill (olddormouse)0 -
If you live in England you can claim in England.0

I have managed to get the statements from both Halifax and Bank of Scotland without any problem. Now the problems start, particularly with the Halifax - they just don't bother to reply. I had a complaint against them last year over another matter and eventually reported it to the Financial Ombudsman, merely because they either failed to reply to letters or it took over a month to respond - eventually through the FO they settled my complaint but it took from April to November - I started my claim with the Halifax in December, sent the second letter and then the third, then sent copies to the Customer Service Manager I had dealings with before, but so far no reply - looks like I'm going to have to issue proceedings. I expect the Bank of Scotland to be the same - its time something was done about what is merely ignorance on the part of the banks to think they can get away with this - they are very quick to take the money out of our bank accounts.0

just recieved a letter today offering my full claim of £5478.00. The letter says "we tried to contact you today by telephone to dicuss your complaint...as a gesture of goodwill we will refund the charges.. blah blah blah. Just as well we were out as I might of accepted less!! Just goes to show that they will pay out without much of a fight. Just under4 weeks since I sent my first letter to reclaim charges.0
