halifax bank charges (merged)

Had a letter this morning from MCOL saying that Halifax are defending the claim
Also received letter from Halifax saying that they will pay £1358 in respect of charges, together with £256.91 interest and also £120 court charges!!!
so do i write to MCOL or select "The defendant admits that all the money is owed"
Also Halifax say that the full amount will be credited to my account within 5 days, but it is in hands of a DCA (£750 overdrawn), would they send me a cheque for the outstanding amount?

I would expect them to credit the amount against your outstanding debt with them and send you the balance - and unless you are disputing the debt itself I don't see how you could get around that as it doesn't sound an unreasonable course.
In answer to your other point, on the basis that they have offered the money with no admission of liability - and I am sure they have - you should write to the court, quoting the case reference number and say that the matter is now settled and you are not pursuing it. Don't fill out that admission bit!0 -
Well today was the day i was supposed to file a claim with the courts, but receive a letter from the halifax offering me the full amount claimed -£1870.00. Thanks to all your help and advice.0

As tempting as it is to accept, i will be waiting until tomorrow (a day before im due to file the claim) and ring them up to 'discuss this matter'. Politely ask them for the remainding money or i will file the claim and remind them that they will then be liable to pay court costs plus any interest.
Fingers crossed
Gave them a ring and was sorted with minutes.
I stated i was not happy with the offer. The nice lady asked what i would be happy with. I said £650. She checked for about 10 seconds and said ' that is fine we can do that'.
All i have to do is alter the original acceptance form with the correct amount and put a note on it authorised by [name]. (The lady i spoke to).
Excellant result.. Thanks for all the advice people and to this site.:T0 -
Hi all,
I sent of my letter requesting my statements from Halifax to the address on the forum, "Data Protection-Trinity road" one.
I did this by recorded delivery on the 2 Feb.
When I use the track and trace on Royal Mail its says item not yet delivered and that is now 7 days since posting
Is it worth it to resend the letter, this time by special delivery?0 -
