    my last code was 647L, I dont know anything about a P2 so i would say no i havent recieved one

    That was the correct basic code for most people - for the year to Apr 2011 (747 from April) when you last worked.

    You would normally get a P2 annually (bulk issue Feb / Mar) if your Code was restricted in any way to cover a benefit in kind / previous year underpayment
    If you want to test the depth of the water .........don't use both feet !
  • Hi, I'm really hoping someone out there can help me. I have just noticed that I have a tax code of 387L and I am wondering if this is correct. I work 3 days a week and earn £22558 gross. I am under 65 and 2 years ago my husband died (don't know if this is relevant but any info may help!).
    I have dug out my PAYE code notice for 2011-12 and it shows the following
    personal allowance £7475
    state pension/state benefits -£3605
    tax free amount of £3870

    Notes for state pension/state benefits say that - we know you receive the state pension or other taxable state benefit and we have estimated you will receive £3605 this year.

    I don't receive any benefits or pensions at all from anyone - my only income is my wage. (I would love to retire and receive a works pension, but that is a problem for another day!:(). I stopped paying AVC some 3 years ago as I could no longer afford to. Does this deduction refer to the amount of AVC I have already paid? Or are the tax office assumptions incorrect?
    My husband always dealt with this sort of thing for us and to be honest I feel very confused as to why the tax office would assume I receive a pension.
    Any help you can give would be greatfully received. Thank you

    It's nothing to do with your AVCs.

    Basically HMRC seem to think you are receiving a benefit that is taxable such as the state pension.

    What age are you? Are you old enough to be receiving your state pension(for women it's around 61 at the moment) but perhaps haven't claimed it yet and HMRC think you have?

    2) The deduction has nothing to do with the AVCs. As it clearly says on the P2 (Coding Notice) note ......... HMRC are of the impression you're in receipt of a State Pension or similar (Widow's pension?) benefit.

    1) But if that's totally correct - then you need to contact HMRC and ask them to remove the restriction from your Code, as it's costing you an extra £720pa in tax. You also need to check what your Code was last year (should have been 647L or very close to that). Bear in mind that HMRC normally are given these State Pension / benefit figures direct from DWP.
    If you want to test the depth of the water .........don't use both feet !

    Jem16, I'm 56 - so a few years short of pensionable age just yet. I received widows pension for the first year after my husband died - but nothing since. So I possibly have a tax rebate due to me (she says hopefully)?
    Sorry if this is a daft question, but what is DWP?

    But - not having read your reply fully initially (sorry) ............ I suspect you will find the restriction is in respect of the widow's pension. But you need to check back (if it was 1 year only) if the restriction was in previous years codings and HMRC are of the impression it's continuing. Or whether it's just been picked up.

  • i wish it was as easy as you all say :( unfortunately it hasnt been that easy for me. i have phoned up quite a few times and also wrote a letter asking for a refund and also through my union, got someone to check and see if we could get a refund. all came back with no.

    i left my job in feb 2008 to start a new job, i have the p45 copy of my leaving date. i stuck my new job no more than 6 weeks,and i then started back at my old job again. not once did i work 2 jobs at any one time. these are my p60s for my current job for which i think i am owed about £1200 tax rebate.

    year to april 2008, tax code BR 6, pay £1,259, taxed £276.
    year to april 2009, tax code BR 0, pay £16,048, taxed £3209.60.

    year to april 2009 is the year we have tried to claim overpaid tax back. i am banging my head against the wall at the minute. i will definately send off my p60s this time as havnt done that before. can anyone tell me if they think i have been overpaid or not??? would be of a great help if we had second opinion.

    If you had no other job / self employment in that year - then yes, you will have overpaid - as code BR gives you no personal allowances (PA). The basic PA for that year was £6035. So you would appear to be overpaid to the exent of (£6035 x 20% =) £1207. How you claim is here :-

    Does anyone know whether the tax code on your P60 slip is the average for that tax year, or just the code at the end of that year. Basically I had some bother with HMRC with my company car so am currently on a K code, but I have looked at my P60 codes, P11D returns and my tax free allowance and think I have overpaid to the tune of £700!!

    this all hinges on my question above as my code changed several times during the same tax year. Last year I got 7 different tax codes as HMRC tried to get its house in order!!!
