Update on my complaint - they have refused it on the basis that they were saying that in their letter telling me they needed further info they were not saying they cant provide a service and I received a welcome email from them that stated that members will be billed then there is no reason for a refund. I think I will have to go through all their terms and conditions now on their website to see what it actually says about what happens if they need further info etc

In the terms and conditions it says you should have received a welcome pack through the post which I know for sure I didn't get. If you didn't get that it might be worth teilling them that they are in breach of their own T&Cs. I supposedly got a welcome email but the T&Cs state by post.

well now I cant even view their website as it keeps blocking it saying their security certificates have been revoked???

I emailed them asking them to post a copy of the terms and conditions too me, which they did. All of my correspondence to them was by email.

Thank you, I will ask them for a copy of them. Im on the phone to Consumer Advice now as well (via OFT website) to see if they can recommend a decent course of action whether to appeal, ask my bank to do this as fraud and request refund or do it any other way0

If you call them on their mistakes and tell them you want a refund or you'll take them all the way!

Consumer advice have given me the no for Financial Ombusdman and said its worth checking the t and c and maybe ask for advice on them from local CAB office. They did say that provider is within their right to request further info for this kind of information and therefore they can say its an active membership even tho I could not access the report. I suppose now the question is if there is anything mentioned about acc being active even if further info is being requested in the t & c. Have emailed them asking for a copy of this.0

Thinking about this now - if they are within their right to request further info to make sure person is who they say they are then surely they are putting themselves up for trouble if someone signs up uses any email thats made up and someone elses card details and then doesnt verify the identity if they write to that adress then they just start applying charges to the person whos card is being used which is fraud?0

Emailed them yesterday asking for a copy of T&Cs as cant access the website to get it myself and I am still waiting to hear back0

They usually take it right to their days they say in the email you should have got back from them.

Thats ridiculous as they only gave me 7 days to appeal and thats from their letter date of 9t may which i received on 11th! Ridiculous people0
